Lucy Tightbox from WATP has been doing streams with a lawyer (she is a paralegal as well). The most recent stream from yesterday discusses this specifically. In summary, their take on it is that an affidavit is supposed to be a statement of facts. Being told SJ’s state of mind by SJ isn’t any kind of fact, it’s hearsay.

Being told SJ’s state of mind by SJ isn’t any kind of fact, it’s hearsay.

A statement made by a party to the suit is going to be admissible.

From the Guide to New York Evidence, Article 8:

8.03. Admission by Party

(1) A statement of a party which is inconsistent with the party’s position in the proceeding is admissible against that party, if the statement is one of the following:

(a) made by a party in an individual or representative capacity and offered against the party in that capacity, irrespective of the party’s lack of personal knowledge of the facts asserted by the party.

It would also fall under the "state of mind" exception to the hearsay rule:

8.41. State of Mind

(1) An out-of-court statement by a declarant describing the declarant’s state of mind at the time the statement was made, such as intent, plan, motive, design, or mental condition and feeling, but not including a statement of memory or belief to prove the fact remembered or believed, is admissible, even though the declarant is available as a witness.

That's weird as Karl said several times how he wishes John would sue so he can get all his financial details in discovery and prove how much (little) he made.

Now he realises it doesn't work like that (though tbf I think the lawsuit threat at the time was Karl getting gigs cancelled and him fired from teaching job) and is scared John will reveal Karl's financials

Honestly, of John's many despicable qualities, I think I find this his most hateably amusing. He's paranoid (justifiably) that everyone he befriends will turn on him (because he's a cunt). So he's determined to get your personal details, allowing him to try and ruin your life the moment he detects an imagined slight, no matter how small.

Karl and Shuli are absolutely right to make this point front and center in their response.

Hell, even if you stay "loyal" in his eyes, as soon as he gets your details the clock is ticking until his wet brain leaks them by accidentally screen sharing his entire contacts list. It's amazing how many of his supposed friends' emails and phone numbers he's leaked through raw stupidity and technical incompetence.
