This is not correct. The 30 days in county jail has nothing to do with his sentence as he hasn't been sentenced. His guilty plea has not been accepted. It's been deferred. It will be dismissed if Nick complies with the courts orders. That order includes 30 days jail (may be deferred), community service, probation, etc, etc.

If Nick fails the above terms, the court can then accept the guilty plea and sentence him. The presumptive sentence is 21 months in prison (not jail) if the court goes that route.

Also, the probation length is 5 years but the court can shorten it. It is very likely that if Nick has a clean probation after 21 months, the court would likely end probation. Sean and the Barneswalker in his memorandom noted this.

It appears the court uses the long times (30 days in jail, 5 years) as big sticks. The court MAY defer the jail time and MAY shorten probation while he is still in deferred adjudication.
