They usually let it slide a couple times rather than instantly violate you. This is probably true even for Nick although he's at a somewhat higher chance of getting treated more harshly. If he just repeatedly pisses hot (and they will test him more often after he does once), eventually they'll lose patience. At that point they might throw inpatient rehab at him. If he fucks that up once or twice, then they may outright violate him.I am genuinely curious if he'll actually serve his sentence. I have no doubt he'll get busted during his probation as he is a hardcore addict and raging narcissist, but will it matter? I consider it a real possibility that he'll get caught, more than once, and the courts will just say "eh, fuck it. You don't have to go to jail. Just a prank, bro." Hope not, because his smug levels would tear a hole in the fabric of reality.

Nick might even get less slack. They have broad discretion in how to handle these things, but are generally lenient at least a couple times. Addicts are expected to fuck up.
Also we had a few people do guidelines analysis and only a couple people were saying anything remotely like five years probation. Barnes and Frei are utter clownshoes lolyers who have been wrong about fucking everything since the beginning and are acting like this is some big win. It isn't. Short of a deviation upwards of guidelines it couldn't have ended any worse for Nick.
Judges don't often do that because an upwards deviation requires a written justification based on facts in the record, and is subject to appeal. Meanwhile, a guidelines sentence is almost always going to be upheld.
