I am genuinely curious if he'll actually serve his sentence. I have no doubt he'll get busted during his probation as he is a hardcore addict and raging narcissist, but will it matter? I consider it a real possibility that he'll get caught, more than once, and the courts will just say "eh, fuck it. You don't have to go to jail. Just a prank, bro." Hope not, because his smug levels would tear a hole in the fabric of reality.

Also we had a few people do guidelines analysis and only a couple people were saying anything remotely like five years probation. Barnes and Frei are utter clownshoes lolyers who have been wrong about fucking everything since the beginning and are acting like this is some big win. It isn't. Short of a deviation upwards of guidelines it couldn't have ended any worse for Nick.

Judges don't often do that because an upwards deviation requires a written justification based on facts in the record, and is subject to appeal. Meanwhile, a guidelines sentence is almost always going to be upheld.

It certainly reads like they don't. I'm not sure why they wouldn't but his streaming would be one reason if he doesn't test hot before then. I'm basing that on the general legal principle that "may" is permissive unlike "shall" which is mandatory.

I'm not sure what is actual practice in Minnesota, but I'd imagine it's generally customary to carry through with a deferral like that if it's granted. I think they want a little wiggle room if some faggot like Nick is "technically" obeying the rules but still fucking up.
 
I have no idea if it is even possible to archive youtube comments, but the DUI Guy has commented (and his comment is pinned as of this message) on the Rekieta stream from last night. DUI Guy says that he disowned Nick NOT because of the positive cocaine test, but because Nick wouldn't shut up. Nick says he accepts DUI Guy's apology.

What I’ve taken away from Nick’s livestream were his comments about the negatives of taking drugs. Namely, that the only negatives were the legal consequences of getting caught.

This addict did not view going on drug binges while taking care of five children as a negative.

Thank the courts for the five years probation. That man will start using again once that period is over, if not before. Most of the children will be legal adults at that point and can escape that nightmare of a household. Judge Wentzell probably saved lives with that sentencing.
 
Typically an addict has to want to change for themselves before they can actually get clean and sober. Sure there are times someone gets clean to avoid a prison sentence, but usually the majority will fail due to the fact they still want to get high and fucked up.
