Because I have no life, I read her entire St. Mary's Mercy Hospital timeline on her website. She claims she was detained and committed without evaluation to the hospital. Her uploads of the arrest show that she did behave aggressively when the police arrived at her house and asked her about her facebook posts. And it looks like, according to the paper work, she arrived at the hospital an hour later. It does seem like she was right that she didn't get evaluated prior to being committed, but the psychiatric documents show she received multiple evaluations after she arrived. However, she is correct that none of these occurred within the time slot they are supposed to. (When she got to hospital on 22/2/2013, she was drugged an hour after arrival, slept for 5 hours, was told she was too groggy when she woke up to be evaluated, and was only given that evaluation days later). Some of the reports say she was 'voluntarily admitted' which is untrue.
So not all of her story is made up, and it's clear the hospital have not been consistently accurate in their account of what happened, but it appears that the real injustices have now become deeply interwoven with the confabulated injustices.
 
They're immune to suit for nonaction. Actually doing something could get them sued.

Are you sure? Because in California at least, LA County Child Protective Services got a firecracker under their ass for letting some helpless kid continue to get tortured at the hands of his mom and step dad.

Autopsy showed that he was starved, beaten and had BBB pellets in his ass.

They can get sued for inaction and the agents dispatched faced prison time.

Well yes, but that's inaction in the face of a crime which is different. It's not illegal to be crazy and it's not like the police are mental health professionals, plus there's not really that many places you can put people away for more than a temp hold.

I get that, how it is not illegal to be crazy. But if you are as crazy as she is, chances are, you are violating numerous ordinances.

They usually hold until you are deemed no longer a danger to self or others.

I cannot decipher from your reply which part of my post you are responding to with your opening sentence. I never claimed that Gina did not need help. However, it is apparent that her qualms with St. Mary Mercy Hospital are not entirely unsubstantiated.

I am saying that I agree with you. And yes sounds like they botched her case from start to finish.

That's the thing though, you're allowed to hallucinate, rant, and drool all you want. I don't see how any of that is dangerous to either herself or others.

Maybe it is an LA County thing (and this place is f*ing oppressive) but if you the neighbor or simple passerby, hear crockery being tossed around in the middle of the night, see her house spray painted "Jesus Raped Me" and hear screaming and yelling at all hours, that is a sign that she IS suicidal or homicidal, even if she isn't sitting in the bathtub with the barrel of a .45 in her mouth saying she's gonna do it.

You call the police and they come to investigate the nature of the disturbance. They see if laws are being broken obviously, but if she reacts hysterically they aren't going to walk away from it. Their job is also public safety, and if the neighbors are too afraid to walk out their door at night for fear of being ambushed by this chick they absolutely have to cart her off.

They drop her off at the local hospital for an involuntary eval and treatment. They don't make treatment decisions, but it is ABSOLUTELY the job of law enforcement, to contain people if they are out of control.

But LA County is a particularly oppressive because there doesn't seem to be a limit on how many times neighbors can call these damn agencies. But if you don't act insane or declare suicidal or homicidal intent, they can't keep tossing you in the mental hospital.

And there don't seem to be many checks and balances in support of our civil liberties.

Not under federal law. DeShaney v. Winnebago County, 489 U.S. 189 (1989). And the police aren't CPS, either. If this is the lawsuit, it hasn't been resolved yet and isn't against the police for not doing something.

I don't know. Not to sound like a broken record but you're allowed to spray paint your own house with whatever the hell you want to. I also don't think that proves she is suicidal, homicidal, or dangerous in any way whatsoever. Crazy? Abso-fucking-lutely. But not dangerous.

Though it's only speculation, I would think her neighbors aren't scared of her, rather more concerned for her own safety, which is why they call the police at all.

I wasn't even familiar with that one. It is the Gabriel Fernandez case. And I think that their complaint is with DCFS and not the cops. The police are mandated reporters, per CANRA so if no law is overtly being broken, they just call DCFS, so that they can go around your 4th amendment rights.

Like I said this place sux, but that is how I get the idea that there are insidious workarounds when it comes time to dealing with civilian matters.

The kid had fuckin BB pellets up the Keister upon autopsy.

Sadly it is sort of understood among law abiding drug-free families, that all of these services (except fire) do little more than overtly violate the Constitutional and civil rights of hard-working good-enough people, and fail to intervene in cases like Gabriel Hernandez and folks this lady Gina Fournier.

I highly doubt she has the funding to move given that she can barely afford food (which was originally being donated to her) or running water in her home and had to walk up to hill to a well every day to get some.
Now that she is being evicted, what are her feasible options? I don't think moving state is possible.

Edit: her current financial situation. Apologies for the poor quality, it was blurry on her site. But transcribed for ease: she'd basically bought a bunch of food and essentials, had $2752.85 left in her bank account. All of that was drained per 'legal processing fee'. Leaving her balance at $0.00.
Interesting that she didn't cancel her netflix subscription though.

Homeless shelter? Threaten to kill herself? Commit some minor crime to get locked up? Her options are pretty slim. There might be some kind of emergency aid.
 
Considering that Gina now has no internet (Spectrum has cut off all cable services until she pays a $150 fee), those tweets will be much rarer.
 
This is getting depressing.

In CA you can be involuntarily committed if you're either a danger to yourself, a danger to others, or gravely disabled. You can be held for 72 hours on a 5150. Two weeks on a 5250, etc. If you're really struggling, you may have a conservator appointed. It's my understanding that most states have a similar system.

Gina strikes me as gravely disabled. She can neither care for herself, nor function day to day. I hope she gets stabilized, and I suspect that's going to mean hospitalization. Nothing about her history suggests she'd be amenable to treatment, though.

Her profanity laden tirades and Exorcist level raging have been interesting, but it's getting to the point where it's just too sad to be in her audience.
