As an avid follower of the Lolsuit, I've seen some misconceptions.

This is not a new Lolsuit. Everyone got thier part thrown out except Asterios. Maddox was given the opening to amend the case. This deadline was for the amendment. So it's still the same case. The sanctions were held up by this opening to amend. Had the deadline passed, then Greenberger would of moved for a date to deal with sanctions. The judge wanted an amendment first.

Asterios committed to seeing the sanctions through, enough money was raised on the legal offense fund for that. I'm guessing that being gone is in relation to contesting this extension, maybe that he can't garentee have the money if he had to respond to an amended complaint.

The exception is because there's actually personal jurisdiction over him as a resident of New York. The other defendants couldn't be sued because not only was there no jurisdiction, but there was no claim against them under a New York law which only protects New York citizens.

So there has never been a decision on the "merits" of the case against Kokkinos as such. Everything the judge said indicates there aren't any merits, but Maddox is free to drive up the sanctions against himself by continuing to litigate frivolously, as is his incompetent lawyer.

As I recall from the transcripts, Asterios was the only person the judge saw even possibly relevant to the case. However, the case was deemed incomprehensible to him. Maddox only got an opening to amend due to the judge wanting to give Maddox the assumption of bringing this in fairness. While we are much more aware of the situation, it's probably a fair stance for the court. We know Maddox is a bad egg, but as far as the judge knows, he's got actionable damages, but his shit lawyer wrote a whiskey slurred mess.

I hope that this only worsens sanctions as Maddox continues to prove what a scum bag he is.
