While juvie/family proceedings take place in a court (of limited jurisdiction), the social service agency doing the investigation is not really a direct law enforcement agency and generally has to enforce its decisions in an actual court. However, a CHIPS proceeding not being (usually) a criminal proceeding, the court can take account of the parents' refusal to cooperate. No cooperation, no kids.

The separate abuse/neglect charges are an actual crime, though, and law enforcement has the power to use warrants. I'm not sure to what degree even the state can use information from these tests in the criminal case, or if that would make them available to the CHIPS case, outside of implied consent cases where the refusal to submit to testing if pulled over while driving is itself a separate crime.

I'm not entirely sure what the legal effect of withdrawing consent after taking the test even is.

I don't know where the kids are, other than not at home. I said one step and if they're not already in a state-ran facility it's a constant risk that it may happen.

Nick clearly hasn't had his "rock bottom" moment despite this being extraordinarily rock bottom. This indicates to me that he's valuing his own ego over existential risks to his children's lives. This is all his fault, his children didn't do anything wrong, they didn't narc. Nick is just such a degenerate he can't even keep up basic appearances. Kayla's parents do not show up in the online database, so it appears their license has lapsed. Aaron and Nick have made reference to them being safe. Minnesota's training manual stresses placing children with family and it is accepted practice, in other states at least, to allow family to take classes to become licensed while they have children placed with them. None of this is conclusive, it's just likely. You'd hope Kayla's parents would have the connections in CPS and know the system well enough to fast track things. The concerns are that sometimes placing with family is avoided immediately so that the parents cannot contact the children while the investigation is in the initial phase and saddling 5 kids on one family is a difficult situation. Splitting the children up is not out of the question.

Do police drug test you for possession charges? They don't in the UK. Either you're in possession or you aren't. They can test you if you're driving, but they've got no right to test you if they catch you with an ounce of coke.

As far as an inability to foresee the consequences his actions may have on those around him, while it is easy to dismiss this as the usual behavior of a hedonist, many have pointed out that they had substance-abusing parents who acted with more regard for their children than Nick. This is where his rampant narcissism become obvious, as he sees his intimate relations as extensions of himself, rather than as other people with minds and emotions of their own. Here is where his potential to unapologetically neglect and abuse his wife and children comes from, and, I think, why the hypothesis that he was dosing his 8 year-old with cocaine to treat her for ADHD is very likely. This deep-seated narcissism is why he can never better himself, as he is unable to admit any failing, and so he continues to find new lows at every turn.

Mostly agree with your post. Minor note: hedonism is inherently self-serving, placing personal pleasure as the highest good. This is more than someone who just wants to "have a silly fun weird good time" or the like. It is a philosophy. The narcissism you are describing is the natural outworking of Nick pursuing the highest good (his pleasure). Nick is/was a self-described heretical hedonistic Christian after all, though he is realistically only 2 for 3 on that.

The parents you reference (with more regard for their children) have abused substances, but Nick made the conscious philosophical decision to become a hedonist. This is how deep it runs in Nick's mind and it feeds into his libertarian sensibilities as well. There is a also meaningful distinction to be made between addicts and hedonists, but I digress.

Just wanted to emphasize Nick's commitment to himself at the expense of others is complementary to both hedonism and narcissism at their core. Nick just naturally leans toward the more self-serving ideologies.

All of his habits in isolation could've been managed by a better man. There are plenty of respectful hedonists, alcohol enjoyers, executives who do coke on weekends who we never hear about because they understand how to effectively segment their lives. Had Nick possessed some self-control and care for others he could've had it all too. He believes that a narrative that plausibly explains the situation will clear his name because he can't seem to conceptualise the existence of facts independent of his narrative.

Unsure what you mean by "managed". Executives who do coke on weekends usually aren't responsible parents of five kids (work all week and then doing coke on weekends means less family time). Generally speaking, people aren't as clever as they think they are when it comes to hiding their vices, let alone segmenting that part of their lives without some distance from others and a fair amount of dishonesty.

Ultimately, Nick's hedonistic/narcissistic lifestyle was incompatible with being an aging responsible parent of five children. This is a contributing factor as to why Nick was in (midlife) crisis and why he has proven to be so irresponsible. Honestly, even if someone were still in college (or an executive), it would be difficult to recommend that they get into heavy drinking, hard drug use, and casual sex (or hookers), if even for only health reasons. If successfully "segmenting their lives" means "we never hear about [it]", then Nick's biggest crime was getting caught. I don't think this is what you were necessarily intending to say, but Nick would agree with this sentiment. To Nick's mind, it isn't about what Nick did or didn't do. It is about what "the government" can prove he did.

For example, according to Nick, no one has driven while impaired until they were convicted. The distinction between being legally impaired due to being caught by police and the biological impact alcohol has on the human body (regardless of police presence) is lost here.

I think you're conflating group homes with foster homes.

I'm not sure how they do foster homes in Minnesota, but in Ontario, Canada to be a foster parent you have to pass some pretty rigid standards. Have your own home, certain equity, tons of communication with the agency, etc.

In my previous career of a child and youth care worker (now fire fighter) I've worked for both group homes and foster homes. Group homes can be an absolute shit hole with children who have been absolutely fucked over in life. In contrast with foster parents I've worked with I never had an issue as they were all committed to being, well, foster parents.

There are plenty of cases where children who end up in foster care get abused even worse by the foster parents who are only doing it for the money than they would be with their original shitty parents.

It says a lot about Rekieta that this is one of those cases where a gamble on getting good foster parents (and I agree that is most of them) is better than having to spend another minute around these deranged, degenerate, evil cocaine addicts.
