But since I have actually read the court documents it is very clear to me that EJ was an essential witness, the docket says a subpoena was issued for him, so it would make sense they would try to serve him since without him on the stand to testify how terribly afraid he was of serious bodily harm, the case is dead in the water.

I am trusting more in my understanding of court procedure than anything EJ would say.

The discussion has been, at all times, about WHY he has remained unserved.

Yes, EJ wasn’t served. That’s kind of the point of people saying that he chose not to go to the warehouse so that he could avoid getting served.

Circling that he wasn’t served doesn’t disprove he was ducking a subpoena. Maybe he wasn’t aware of it when his other employees got served, but he probably was aware of it.

Note that EJ posted no receipts of his communications with DA investigators except the one to at least his two employees that tell them to not show up because the case had been dismissed. You’ll see EJ was not on that email. Him citing that email post-dismissal as proof of anything should make you suspicious.

I think it’s worth asking why this case was dismissed at the last second after these subpoenas went out. Was it because of the motion to quash? All they would have had to do was remove a paragraph to proceed.

Was it because they thought the case was hopeless even with EJ attending? Probably wouldn’t have bothered sending any subpoenas in that case.

The EJ fanboys can’t have it both ways. Either you believe that the DA’s office thought it was a stupid case that they had no probability of proving WITH OR WITHOUT Eric July, or you believe it’s just a case that they thought they had no probability of proving WITHOUT Eric July. Both could be true, but the latter scenario is definitely true.
