I don't have a statistic on that but it definitely happens. Declining to engage in an enforcement action isn't, by itself, a statement that the case has no merit, but is often more the result of a limited budget for enforcement. They will almost never issue a statement that basically amounts to "yeah this case has merit but we're not enforcing it" or "everything that guy just said is bullshit" but it's sometimes helpful to one side or the other. There are definitely a lot of money grubbing Greersuits of this nature, though.
