Well they charged a guy for two different levels of murder for the same crime, so I dunno if "isn't that stupid applies"
but yes, because though it's obvious that the prosecution/state just wants to throw the book at chauvin and lock him away for a billion years for the crime of being made a scapegoat, they know they obviously can't prove he was trying to kill floyd, especially because they already know they're gonna have a hard enough time trying to prove he even did kill him

I mean, people generally overestimate what 1st degree murder actually entails in terms of what 'premeditation' means but it was clearly not here.

There isn't a first degree murder charge, so no. The charges are "second degree unintentional felony murder, third degree 'depraved mind' murder, and second degree manslaughter." Before the trial, there was a guy who claimed when they both worked for the same nightclub as security, they had some kind of beef, but he recanted.

I think in that one he used the "I CANT SEEED" excuse too. Proving that him saying that was well known to the officers to think he was crying wolf.

I wish they tacked on 1st degree murder just to see how they can even try and prove that. 1st requires some premeditation which would be fucking bonkers in this case. As Chavin dident know he was going to murder a jogger that day or when he got the call.

Personally I don't see the reason to be paranoid about jury bias like people have said, we all saw them being selected and if they told any lies, you can guess what that means for appeals. It's really a question, or seems to be, of if the pros is so comfortable they'll fall asleep at the wheel, and if nelson can slowly and steadily introduce enough doubt to make for a level of reasonable doubt that even slightly biased people would have to accept

its not about bias, but about fear and intimidation.
if they acquit, their own city burns. they have friends and family in there. and they might even get doxed themselves and targeted for reprisal by blm.

I think it was a mistake not to throw in some kind of aggravated battery charge to guarantee a conviction if they can't convince the jury of the weird grab bag of homicides they threw at him, which all require contradictory and mutually exclusive mens rea.

I think the prosecution has at least shown what is at best a sub-optimal use of a restraint procedure at the outer limits of what's allowed, but I'm not in the least convinced it was the actual cause of death, which looks a lot more likely to be a combo of decades of drug abuse, which certainly did no favor for his severe heart disease, combined with sickle cell trait, combined with stressing out his already weakened heart with a drug fueled chimpout.
