In 1960 the new state of Hawaii had a dispute over the results and sent two sets of electors. When it turned out that Kennedy had won, VP Richard Nixon selected JFK slate of electors. If there had been only Nixon electors this would not have been possible.

So if a state is disputed it behooves the party disputing it to send their own slate of electors just in case the dispute works out in their favor.

So what's likely to happen now? And I am sorta confused why people are claiming it's just GOP larping more than anything. Seems really weird to me.

There are two possibilities per state. One is that the recounts, court challenges, and state legislature motions do not change the outcome. In that case, the Biden electors get counted on January 6th. The other is that they do and then the Trump electors get counted.

It's also possible there's going to be some sort of revelation that Biden is a Manchurian candidate or that Dominion is a fraud machine or the Executive Order is invoked. And then all hell breaks loose and Pence has the political cover to choose the Trump electors.

In my opinion, the only remedy for the SC on any given state is to say “its fucked yo” and decertify completely. Nobody gets it.
But the Court has already made it clear they don’t want to be kingmaker.

Yeah, it is true that SCOTUS doesn’t want to crown anyone. Which means that if it turns into a contingent election or if the Senate goes with the alternative slate the Republicans have sent in, things are gonna get real interesting, real fast.

So i'm reading Donald J Trump for president inc v Boockvar and the first thing i notice is that it was filed back in june of 2020. I believe this was the case where Boockvar's lawyers threatened Trump lawyer's causing them to drop out.

But it's interesting to read the defendant counties' claims (there were a lot of counties initially) say the case should be dismissed because other lawsuits are pending and that the case is going to disrupt the upcoming eleciton.
