And while I get the plan to continue defaming because they hate him and it’s all they have, I can’t help but wonder; what the fuck else can they do to him that’s worse than what’s alread been said and done? Are they gonna call him a rapist? Blacklist him? The damage is done, even if it still hurts to be continually defamed like this, Vic has nothing to lose.
Ty dropped a line about mutually assured destruction in the first hearing, which reminded me of a strategy that was considered during the Cold War; don’t immediately respond to a nuclear attack, and hold the enemy’s cities hostage as a way to leverage the situation. If you immediately retaliate and wipe them out, then they have nothing to lose, and will continue the offensive with a vengeance.
They have alread nuked Vic thoroughly, and nothing else they can throw at him will deter him, especially after they failed to produce anything damaging during depositions.

Ty and Nick went over this on their livestream last night:
1. If MoRonica wins the TCPA that this is lawsuit doesn't count as defamation Vic owes Monica and Ron Toye (an alleged Pedophile) legal fees. The case is thrown out.
2. If Emporor Tyranicus Bearidus defeats this motion on the grounds that the TCPA/Anti-SLAPP was frivolous then MoRonica owes Vic Legal fees. The case resumes.
Honestly there was no path forward for Casey and Da Fuhrer to go as MoRonica probably hasn't paid them one shekel yet.

That picture and that part of the article was debunked by the very person in the picture of the article itself.
They’re betting on ty not having and affidavit for it but the public statements she made (because the article was public) will be enough to defeat that part of the TCPA
They lost this case as soon as it began, twitter law knows it’s lost and continue to pretend liability lies on Nick because Nick has constantly proved them wrong and humiliated them worse than he humiliated Shane.
They have NOTHING.

I'm simultaneously laughing at this hilarity while shaking my head at their strategy of using the shield of official court documentation to further slag Vic.
Also if the motion is defeated it doesn't automatically mean Ty gets awarded fees. It only happens if it's shown than the TCPA was frivolous.
To elaborate, a TCPA can be successful (MoRon is removed from the case), partially successful (Court finds that there is a prima facie case for some causes of action, but not others, and/or BHBH has to submit an amended pleading), or defeated (let's go to trial, bitches).

It appears to me that they are creating tons of fact disputes. At least in the area that I'm familiar with, getting judgments as a matter of law involves pointing out the complaint is LEGALLY deficiency and amending it further would be futile. Beyond the unprofessional and bombastic rhetoric (which most judges hate by the way), this seems like a war over facts, a matter only a jury can weigh and resolve.

Wargames is a movie that I'll put dollars to donuts Ty grew up watching. There's a scene in there that describes M.A.D very clearly, very simply, and very elegantly. I highly urge those of you who have not seen it, go watch the movie. The tech was cutting edge at the time (80s) you can safely ignore much of it, take the context into consideration.
Also Sun Tzu's saying about trapping the enemy in the corner, for when you do that they have nowhere else to go but ATTACK. Always give your enemy a way out that you know of and can control. Das Fuhrer Lemoneysnicket and LowTshots gave Vic no other option as surrender is equivalent to Social Death( and loss of income) so Vic must continue to fight until the end.

That whole twitter thread in general is a remarkable laugh if you want to read through the direct link of couchette taking out of context clips as a nice GOTCHA to the case. I’d archive it all but then it would have to go in the couchette thread and not in this law thread.
They still haven’t learned that context is what’s going to lose them their TCPAs and this case in the first place.

He’s either got his head embedded in his asshole, or he’s panicking to salvage his ego. There’s no way a sensible person would read the affidavit as anything but absolutely disastrous for Rial. Stan was named as a fact witness and disputes the claim, under oath, full stop. No amount of pedantry over wording is going to change that fact I’m the eyes of the court.
Sure, “I don’t remember to my knowledge and I would have acted quite differently over the years had this occurred and I had witnessed it” is technically different than “This didn’t happen”, but god damn you’d have to be dense to think that it doesn’t at least put Rial’s honesty in question.

A hearing needs to be held within 60 days of the filing, and a ruling within 30 days of that hearing. So a max of 90 days.
Betting that Chupp will shoehorn this TCPA hearing into Funimation's August 8th hearing.
