That absolutely would have been the right thing to do. But most CEO's are sociopaths, so they would be incapable of thinking of something like this.
I can't count the number of times a CEO or C-Suite executive could have done this to make something go away when it was minor, but they didn't, an then they ended up fighting an asymmetric holy Jihad that brought the company to its knees. Also will add that the fact Ben uploaded this onto the second channel, not the main one, does not look good for him. It's good he's addressing criticism. But the fact that you upload this on your smaller channel kinda shows you don't want this to gain as much traction as if the video was uploaded to the main channel.

Im generally not a virulent cop hater but I am acutely aware that they arent your friend and its pretty much nothing short of an act of God to find one that honestly wants to help and isnt a narcissistic faggot that is upset they didnt get to just idle in their car for their entire shift. Auditor channels have done some pretty great work to help people understand what their rights are and its something that i appreciate a lot. QI is one of those things i could see in honest, true mistakes but cops too often wipe their ass with the constitution and short circuit when their often non-authority isnt respected with immediate and abundant ass licking. Its endlessly frustrating that someone who is permitted to kidnap and imprison someone can just bark, "were not doing roadside court, save it for the judge". And then when they break some of the most fundamental and easy to understand laws around speech, recording, whatever it may be, they get a paid vacation or moved 20 minutes to another station.
The lego stuff is honestly pretty inconsequential to the bigger picture at this point. I just listened to his interview on the Mormon podcast and he actually explains what happened with suing the wrong company, he says it's a spoiler for part 3.
Basically, he found out that the BAM store in question did not have an LLC on record. So he was told by the court that it's legal for him to sue the previous LLC which he did.
But then he found out that the storefront and the backroom are zoned as separate addresses and the actual LLC was assigned to that other address, which was not listed anywhere on public records.
Essentially, he got tricked by BAM's legal judo trickery to obfuscate legal proceedings against them.
The family that owns BAM also owns LegallyMine which is all about asset protection and getting out of paying taxes. This sounds like something they would do.

We are entering a wild west of journalism with youtubers. The old system is dogshit because our courts are slow, costly, and biased.
Presentation and making yourself look good in public opinion is important too though.
He needs to work on the second part a bit more early on I didn't like him, but the rest of it warmed up to me because of how more unlikable the other people were.

His "good faith" attempt to settle out of court wasn't to have an attorney email the owner, but to show up at his home unannounced with a gaggle of other retards to get content.
You're wrong tho. His good faith attempt was entering the store with only his camera man with the contract to ask for the legos back. The store manager then immediately trespassed them and called the police. At which point he called the owner who immidiately denied and said "call the main office" and if he disagreed to "sue him" he went to the main office which then said "discuss this with the franchisee".
As he returned and started talking to an employee said employee revealed that the franchise owner had called with the manager and was looking for ways to arrest him. All of this was before all the fuckery he then started to do all the extra stuff ending with 10 seperate instances of small claims court and the franchise owner shut the store after being served. It was only then that they went to his house to serve him which is still within legal rights.
