FRISCO, Texas — Karmelo Anthony, the teen accused of fatally stabbing another teen, Austin Metcalf, at a Frisco track meet, has been indicted on a murder charge, officials said.

A grand jury indicted Anthony on Tuesday, according to the Collin County District Attorney's Office. A murder charge is punishable by 5-99 years or life in prison.



Anthony, a 17-year-old former student of Frisco Centennial High School, was arrested and charged with murder in the fatal stabbing of Frisco Memorial High School student athlete Austin Metcalf in April at a track meet in Frisco ISD's Kuykendall Stadium. He was released from jail later that month after his bond was reduced from $1 million to $250,000.

Anthony has claimed self defense in the case, which garnered national attention, heightening racial tensions and raising security concerns among everyone connected to the case, including both families and Judge Angela Tucker, who is presiding over the case.

"We know this case has struck a deep nerve — here in Collin County and beyond," Collin County District Attorney Greg Willis said in a statement Tuesday. "That’s understandable. When something like this happens at a school event, it shakes people to the core. But the justice system works best when it moves with steadiness and with principle. That’s what we’re committed to. And that’s exactly what this case deserves."

Anthony's attorney, Mike Howard, called Tuesday's indictment "an expected and routine step in the legal process."

"Karmelo and his family are confident in the justice system and the people of Collin County to be fair and impartial," Howard said. "Of course, Karmelo looks forward to his day in court. It's only in a trial that a jury will hear the full story, one that includes critical facts and context that the grand jury simply didn't get to hear."

Howard again raised Anthony's self defense claim in his statement Tuesday.

"We expect that when the full story is heard, the prosecution will not be able to rule out the reasonable doubt that Karmelo Anthony may have acted in self defense," Howard said. "Self defense is a fundamental right guaranteed every American."



Metcalf's father, Jeff Metcalf, told WFAA in a statement that he's "pleased that we are moving forward."

“With the first degree murder indictment, it now goes into the court system," Jeff Metcalf said. "I fully believe that justice will be served for Austin Metcalf. I look forward to the forthcoming trial. But it will never bring my son back.“

Under his bond conditions, Anthony is required to wear an ankle monitor and ask permission to leave his home. If Anthony violates any conditions of his bond, he will have to return to jail. He graduated and received his high school diploma in May, but did not attend the ceremony, WFAA previously reported.

Anthony allegedly confessed to the stabbing immediately after he was arrested, claiming he was defending himself from Metcalf, officials said, as WFAA previously reported.

A witness reportedly told police that Metcalf told Anthony he had to move out from under the Memorial High School tent. Anthony responded by opening his bag and reaching inside, WFAA previously reported.

"Touch me and see what happens," Anthony told Metcalf, according to a witness.

Metcalf reportedly then touched Anthony, the witness told a responding officer, and Anthony told Metcalf to punch him and see what would happen. Soon afterward, the witness said, Metcalf reportedly grabbed Anthony to tell him to move. At which point, the affidavit continues, Anthony reportedly pulled out what the witness recalled as a black knife and stabbed Metcalf once in the chest before running away.

The deep tension sparked by the incident has raised concerns that the case may be tried outside of Collin County. Collin County District Attorney Greg Willis told WFAA that the judge will make that decision at the time of trial.

I want to reiterate this as I did yesterday: there is no cap for his age because in Texas, 17 year olds are charged as adults. There is no cap. He is eligible for life in prison.

"Texas Penal Code - PENAL § 8.07. Age Affecting Criminal Responsibility​

(7) a capital felony or an offense under Section 19.02 for which the person is transferred to the court under Section 54.02(j)(2)(A), Family Code.
(b) Unless the juvenile court waives jurisdiction under Section 54.02, Family Code, and certifies the individual for criminal prosecution or the juvenile court has previously waived jurisdiction under that section and certified the individual for criminal prosecution, a person may not be prosecuted for or convicted of any offense committed before reaching 17 years of age except an offense described by Subsections (a)(1)-(5).

(c) No person may, in any case, be punished by death for an offense committed while the person was younger than 18 years."

The only thing he is not eligible for is the death penalty, which is extremely unlikely to have been considered anyway.

Either he wasn't offered a plea deal, or it was very close to the likely sentence for his situation (which his lawyer would likely know), so he decided to go to trial.

That, or he and his family are truly retarded & delusional and think he's got a high chance to walk, and decided to pay an expensive lawyer a lot of money to probably lose. They come off as entitled speds and got a huge pile of undeserved money, so maybe its that simple.
 
I think there is some confusion on the knife or knives

For what I gathered there are 2 knives, one that was in the backpack, that's the smaller folding knife, and the one used to stab Metcalf. Which was the larger one the nigger tossed away as he ran from the scene. That one has a 6 inch, non-folding, blade.

First female teenage witness

The prosecution called a former Liberty High School student to the stand. She explained that she is in the Class of 2026 and just graduated. Her mother is a former prison guard.


She testified that on the day of the incident, she was at the track meet with the Liberty High School team. Liberty had two tents: one for girls and one for guys. The tents were located next to the Memorial team's tent, approximately five to six feet away.

The witness testified that attention was drawn to the Memorial tent. She heard a commotion, looked over, and saw a verbal argument. She said she witnessed Austin telling Karmelo to get up and move, and Karmelo refusing. She then looked away because her friend's race was starting, and by the time she looked back, the stabbing had already happened.


She testified that Karmelo was the aggressor and that she believed a fight would happen. She said she did not think Austin wanted to fight.


When asked about what she saw, the witness began to cry. She could be seen wiping tears from her cheek.

The witness told the jury that the interaction had nothing to do with race and that she thinks it had nothing to do with self-defense either.


She said she passed information to the police about the relationship between Austin and Karmelo, which she now knows is incorrect. It is unclear what specific information she told police about their prior relationship.


During cross-examination, the witness told the jury that she remembered Karmelo saying that if they wanted him to move, they would have to move him.

Shook asked the witness for more information on what she told police about something she heard Karmelo say. She then admitted that she didn't actually hear the information.

He's a well to do black kid who, despite not having those so called socio-economic factors, found it within himself to go about robbing his fellow students. And when caught robbing his fellow students his response was immediate murder.

Could raise this kid in the perfect environment and he'd likely do the same. Don't let his crocodile tears pull at your heart strings.

When describing the interaction between Austin and Karmelo, the witness said that Karmelo "provoked" Austin. The state drilled down into the witness's use of the word "provoke," asking whether he understood its legal significance. The witness says no, but that he thought it was the right word for what he saw.
Smart of the prosecution to cover this before the defence lawyer starts trying to pull some legal jew-jitsu over the legal definition of provocation

It is for him and for the people defending his argument. He doesn't get that his presence that was not allowed, he knows that he was there and people were wrong asking him to leave. Even if wasn't stealing, he was there and he had the right to be wherever he wanted, otherwise it's racial discrimination. I'm sure many blacks have already "figured out" in their minds that Austin wanted him out not because he was a stranger in the tent, but because Karamel was black and he was racist.

It's rather scary how in modern society that police-related shootings or even high profile cases like this end up making or breaking midterms since A, they do not know (or refuse) how to act; B, society is expected to just accept this behavior because C, social justice has contaminated every institution to enable criminality and low-IQ behavior because they're brown.
