Not the worst ruling. Basically, you can't impose tariffs unilaterally even under emergency powers, you have to go through congress. It's not a knock on policy just on procedure. It takes some of Trump's leverage in negotiations but that's about it. It's highly unlikely that any money will have to be paid back unless entities sue for them and win.

Some companies did sue, including Costco, maybe they'll get some cash back.

Bessent seems like he's the type of guy to be 3 or 4 steps ahead, and they had to expect that SCOTUS would strike it down. The repayment aspect is the only one that concerns me a little bit.

The way they were talking about it/bringing it up randomly ("Oh, we feel confident SCOTUS is defintely going to rule in our favor") gave me the vibe they knew.

Anything in place pre Feb 2025 remains (those were all under different statutes) and anything in place after Feb 2025 that used the same sections as pre Feb 2025 tariffs.

Plus there are other statues Trump can use but they're a bit more involved and require formal investigations.

It sounds like Trump will have to jump through a few more hoops before instating a tariff which while retarded, is not the end of the world.

Alternatively, we win the midterms and Congress can pass a law making it easier for the executive to enact tariffs.

Yes and those hoops take time and move at the speed of government (think back to Obama trying to tariff Chinese tire dumping, shit took YEARS to get into place and by then the Chinese already made billions and nearly bankrupted the entire non Chinese tire industry)

Plus the average tariff rate isn't zero, it's more like 6% now vs 15% average.

Which do these apply to?

Steel & Aluminum, Automobiles & parts, Copper products, Semiconductors. Section 301 tariffs are primarily everything from CHINA!!!! and were implemented during his first term.

The IEEPA tariffs are all about Fentanyl (China, Canada, Mexico) or reciprocal tariffs with a few muh deficit things sprinkled about.
USCMA is up for renewal soon so Trump is most likely going to let that die.
