You are misunderstanding me. I think it might still be a good shoot. It all depends on who fired the first show, and if it was an officer (which I assume at this point), what his reason was for doing so. If he was unaware he was disarmed and saw him going for his holster (where he might have seen the gun before), this could still be a good shoot.

The easiest way to avoid getting ventilated is to not resist arrest.

rewatching this specific video, i think many people in this thread are incapable of seeing. you can look at the gray coat guy and see that he is not ever in a position to reach to the front of this dude's waistband. he also didn't pull the trigger, as there's no muzzle flash. it's almost certain that wherever the pistol went off, it was in that ball right as they're about to shoot him, and you can see him make motions after the one ICE guy comes up and wallops him in the face that he's leaned over and has his arms near his own stomach.
