Regarding spoliation, tiny said earlier that he has no obligation to keep his private DMs or to risk them going public. He said as long as he preserved them well, it's okay. It's possible he has kept version of the untampered logs and is just creating theatre in these filings which are not at risk of perjury. It is also possible he is aware that logs can be obtained from the sources (like discord, Google, etc) and is just killing time until then, or that they have already been requested but he knows they won't be revealed in these early filings.

There was also a period when Pxie asked him to do everything he could to erase her video from the internet (before she sued him). He could argue that all the deleting of evidence was to honor that request, though much of the deleting of logs didn't happen until after the lawsuit was initiated. Nothing Bretler did as of now is “impressive” in any way.

The truth is, Pxie would probably have gotten the 2 latest motions rejected even if she was shooting in an empty net.

The judge didnt rely on any obscure legal theory found by Bretler’s team. He relied on extremely basic concepts like “the Federal Court can’t compel a non-party” and “It took too long to file and the damage is already done (aka the basic criteria for injunctive relief)”.

What did Bretler do to justify his exorbitant price tag? His prose is better that of Pxie’s team? I guess, marginally. But he mostly milked Destiny by doing stupid shit like opposing a motion to amend. And he clearly isn’t guiding his client enough, exposing him to being held in contempt of court and making him admit retarded shit like the fact that he’s completely recreating logs.

On the merits, the outcome of the case hinges on three things :

A) Will the judge accept the continuous distribution theory ?

B) Will the jury believe AbbyMC ?

B and C seem like the best bets, but it’s definitely not won in advance.

It is. One of the criteria for preliminary injunction is showing that you are presenting a strong case (in other words, that you are very likely to win). The judge is bringing up that there seems to be a serious challenge to court’s jurisdiction, so this criteria is not met. He’s not ruling on it though, he’s merely saying that Pxie’s case isnt a slam dunk.

Sorry I should have clarified that it was speculation based on a couple of todays posts and would make sense if true. The fact that he was sending cropped CSAM to Solo around the date Destiny’s gay op find Rose group was going, just made me think back to the comment about some of the members of that group asking Destiny not to share the video if there was a risk of it being CSAM. I don't think there was ever much of a debate that pxie's case had an uphill battle and destiny's lawyer was in a different league than pxie's team. Destiny's lawyer is a famous expensive celebrity hollywood lawyer and pxie's lawyers misfiled like 80% of things they sent in for the first 6 months of the trial.

The problem for Destiny (aside from the abbyMC affidavit and texts which pretty much guaranteed this is going to trial) is that he's trying to save money by doing some DIY lawyering on his own and paying brettler for drafting responses of Destiny's design. It's just totally out of line with the type of client brettler usually represents.

Could you imagine bill cosby trying to reconstruct chat logs on stream with a woman named henry and kvetching about how "information is lost"? The logs are critical to the case, he should have had a professional put them together at minimum, and then probably also have them sign an affidavit acknowledging that the logs were well preserved. But he's trying to save money on legal costs so he did it all himself over a few hours at like 2am while chatting on stream. And he obviously shouldn't have publicly stated that he didn't correctly preserve all the logs. And aside from that he should have actually preserved the logs in the first place rather than panic deleting things, preserving some, editing others. It's just a huge mess.

It's the quintessence of the lolcow. The hubris in reconstructing the logs himself, layered on top of the hubris to go on stream and declare that the logs are "incomplete", layered on top of the hubris to hire a celebrity lawyer that is way beyond his budget, layered on top of his hubris to not just settle in the first place when he is very obviously guilty of what he's being accused of.
