I don't think they ever had a viable defense other than hoping for the prosecutor to drop the ball, badly. Dave filmed a crime and proudly posted it. He refused to take a deal because he's Dave. It appears to me Dave attorney has finally convinced him that taking this to trial was a bad idea and that any testimony by him would only further incriminate him.

The prosecutors panties have probably been moist all week as the thought of getting to bully Dave to death on the stand. The judge will never say it, because it is improper, but I bet he gets trial taxed relatively hard. Him not testifying makes the only thing the trial effectively did be traumatize his parents. If he testified then his lawyer could atleast spin it as him getting "her truth" out.
