He tried to slip in a probable cause challenge through her case because he and his lawyer fucked up and forgot to raise the issues during the Omnibus Hearing, effectively waiving them. If this challenge of probable cause had resulted in evidence being suppressed or the case being dismissed for Kayla, then Nick would have had a good case to appeal in his own case.

There was also no reason for the personal attacks aimed at Aaron in the filings, the entire thing was very unprofessional and unbecoming of a professional lawyer. Kluver is a professional, she is an elected attorney in a county, had about 250? active cases in Minnesota within a year.

1) They would have to prove that Kayla was damaged by an act of revenge porn that involved at best one image being shared with one person who seems to have looked at it once on their cell phone and disposed of it.

2) The damages associated with revenge porn are usually associated with uncontrolled public dissemination of an image on something like the internet. That the images get out in an uncontrolled way on the internet and thus do damage that is not easy to address. That didn't happen in this case.

3) The case would be around a person arrested for drug charges who had their children taken away by the government for six months and has been shamed in public as a sexual degenerate and swinger claiming that during all those things going on she suffered great personal or reputational harm by Geno allegedly seeing a single nude picture of her.

4) A criminal case or a criminal trial helps with establishing facts, but it does not help with establishing damages. The criminal law was written in a very specific way such that distribution of one photo to one person is revenge porn. But civil law would be about proving damages.
