Is it really out of the question that Kayla may have been a normal, functional human, but for the malignant narcissistic husband gaslighting her for years? It's not hard to see her cheerleading picture to see she had a little life in her eyes then that she doesn't now, and it's not just age. Never the brightest bulb, but normal youthful life. By contrast, in the last few years, she has not looked like a typical late 30s/40-yo woman. Probably for a lot of reasons, none of which have to do with the mere fact of having 5 kids. I've known a lot of women with 4 or 5 or 6 (or 8, omg) kids. They aren't perfect and don't have perfect husbands, but they didn't lose all life in them. And not one of them got arrested with their husband and his girlfriend.

Living with a malignant narc will suck the life out of you. But it doesn't remove your brain. Kayla's problem is that she chose to stay with him rather than doing the hard thing and saving herself and her kids. Probably a lot of other things in her life encouraged that - community, church, family, access to money. But the biggest are the vampire she lives with and her weak and lazy approach to life.

It's actually a really fucked up double-bind for Kayla because, if she stays then she's endangering the kids by putting them near Nick. If she leaves, she's endangering the kids by putting them near financial precarity (or outright putting them there). Whatever she does she's fucked.

This is why women should work, at least at some point in their lives, even if they embrace a traditional stay-at-home life once there are kids. It gives a sense of self and confidence that you can survive, come what may.

I waffle on judging her for not leaving - she should have a spine, but in addition to a gaslighting manipulative bastard for a husband, she had a whole existence, community, church, etc., that frowns on divorces and encourages people to stay together no matter how much it crushes your soul. But I fall to the side of accountability because she's had 20 years to do some minimal level of learning and planning, and to choose to be a person rather than an accessory. But if he actually defends the charge in a trial, the prosecution is going to have to bring anything relevant they can, even if it's to rebut Cuckieta fairy tales about cops planting drugs, bogus drug tests, and other shit that could conceivably create a reasonable doubt in the minds of the jury. So the positive test could actually be relevant if there's any chance whatsoever of Nick getting acquitted.

It's also highly relevant to the level of culpability and where in the guidelines range the sentence should be.

After all, if it's just a technical violation and nobody was harmed, there's no real reason to be especially harsh in sentencing. When a child was presumably actually harmed as a result, and in circumstances that are extremely morally repellent, the sentence is likely to reflect that, or even qualify it for an upward deviation out of guidelines range.
