If I was April I’d be worried. Probably not. The prosecution would not drop the charges against Nick. Kayla would have to take the stand in Nick's trial, tell a story that would convince a jury that Nick was completely innocent and then survive cross-examination on the stand by the prosecution. She would be pleading guilty to all the drug and neglect charges. She would also be possibly exposing herself to new charges were she to lie in her testimony.

Now he is moving to an incredible longshot argument of trying to convince a jury that he has no idea where nearly an ounce of cocaine, scales and various accessories in his bedroom in his house where he has admitted to the police that he sleeps came from.

A more subtle change was his noting that 1st time drug offenders rarely get jail with plea deals.

He then changed the argument that his goal is to "maintain his liberty" from the original "they can't prove it." He talked about multi-year probation being an obstacle to moving. He'll get deferred adjudication on a felony, with 60 months probation. And with his idiotic statement on posting bond to avoid drug test fees, I hope they order 5 years of random drug testing at his expense. 5 years of home inspections. And a GAL.

He's setting up a plea. He'll never say he's "Not guilty" again but he'll say he had to do it to move on with his kids. He'll still argue the state never proved their case and couldn't prove it (they didn't have to because he'll admit it in the plea).

It's a subtle but noticeable shift in language in that interview. He's going to take a plea and agree to do everything that keeps him out of jail and gets his kids back. He'll spin it as a win for him over the evil state. And of course, the only thing the state ever wanted was him safely taking care of his kids.

They are separate cases. Theoretically she could plead guilty and say it was hers. The state can still charge Nick and the defense would have to call her as a witness. Whether that would be enough reasonable doubt that Nick didn't control or possess any of the coke in his house and safe would be up to the jury. Ownership and use of the drugs are not the crimes alleged, it's possession and control. Kayla claiming possession doesn't exclude Nick from possessing also. It's why they are both charged for the full amount.
