Legislatively, you would have to ban the disparate impact standard. There is a very good law review article here with the self-explanatory title, "Title VII Disparate Impact Liability Makes Almost Everything Presumptively Illegal." This would require a monumental shift in American opinion, since most people believe everyone is fundamentally equal. Anyone who's been a teacher (and isn't some psychotic troon or whatever) can tell you just how deeply that assumption is built into American policy & culture. You would also need to require the EEOC to write regulations defining what is and isn't discrimination. A legal regime where the regulations are bullshit, but at least I know what they are, is preferable to a legal regime where the bullshit is Calvinball.

There are racial and gender disparities in everything. Think of a thing that is characteristic of human beings. Literally any single thing. Who drinks the most water? How does caffeine affect people? Who responds the most effectively to various cancer treatments? Who sweats the most? Who metabolizes sucrose the best? Who has the fastest eye-hand reactions? Who listens to the most music? If we have statistics, and those statistics are disaggregated by race and sex, you will find disparities. A recent example is that a men's tailor found that for online orders, they could get you the best fit if, in addition to the usual measurements (waist size, inseam, etc), they asked for race. You see, the overall shape of a man's body varies by race. And yes, black men need a little more space in the rear of their trousers, and Asian men don't need much at all. But asking for this information, and cutting trousers to fit, is legally risky due to Title VII.

It becomes even riskier when you realize that black men's trousers use more fabric than Asian men's trousers, so if you were to charge people based on the cost of materials, you would introduce a racial disparity in fees, which would be illegal. So in order to avoid fines, at minimum, you need to offload the cost of doing business with black people onto Asians. Which introduces more risk. You need to figure out, ahead of time, what business strategy will make a judge happy, not what actually delivers products to customers that they want and maintains profitability.
Okay, but to be entirely fair, you need to acknowledge the well established legal principle that disparate impact alone is not sufficient prove racial animus. if it was, we'd have a lot more retarded civil rights decisions out there.

Granted it could be a larp (since anyone can claim to be anyone there and just shitpost stuff for lulz) but there was a post on 4chan from a so-called "Washington Insider" over the weekend that claimed that they are forwarding Justin's increasingly deranged demands that Biden help him against the truckers, to surrogates and Kamala. Because Justin has gone full mad king over being defied by the truckers, they don't want him in a room alone with Biden given his condition. And that Justin's already burning bridges, calling Kamala "Biden's token" to her face when she met with him to discuss leaning on US media groups to help smother any positive stories about the truckers and basically refusing to speak to anyone but Biden due to him feeling that America "doesn't care" about "his humiliation" at having to flee because of the masses revolting against him.

Basically the Civil Rights Act gave the federal agencies it created near-unlimited power, same for the courts that hear civil rights cases.

They'd never say it outright, but it is held in higher esteem than the Constitution itself by the legal establishment, and this is reflected in legal education. It will never be overturned and a truly honest historian will point to it as the source of a tremendous amount of American woes. Most historians are not honest.

What do you mean, Trudeau copied Biden's mandate system, or he tried to get Biden to copy Canada?
There's been rumours that at minimum the border mandates, particularly the cross-border trucking mandate, have been a deliberate collaboration between the US and Canada. It's highly unlikely Biden is directly copying Trudeau (lol if actually the case), but the border policies of both countries aren't being decided in isolation.

Best example of this is the 360 Canada pulled regarding the trucking mandates a few weeks back where they were cancelled only to suddenly be reinstated less than 24 hours later - it's likely Canada thought the US was also ready to rescind them only to get told otherwise and so had to backtrack.
 
The Canadian trucker strike would never happen in America. The leaders would have their bank accounts seized and would be bagged and sent to black sites within hours.

I think he's right that the media are, to some extent, highlighting the Biden admin's collapse and are playing up the "threat" of a Trump 2024 run for ratings purposes, as well as to salvage the last shreds of their credibility. Trying to paint the Biden admin, which is clearly failing by purely objective measures, as being all roses and sunshine would just make them look even more like American Pravda than they already do. But there is a common cope among leftists that "Blormpf only won in 2016 because the media gave him attention", since they can't face the fact that people who vote for Republicans might have agency and legitimate qualms with the Democrat party.

Maybe in the hinterlands but the big cities are just as "vibrant" and bugman-infested as any American city. Vancouver is basically a Chinese overseas territory at this point and there are huge swaths of the Toronto area where you would be hard pressed to find a white person. Calgary and Edmonton both have Punjabi mayors.

President Joe Biden urged U.S. governors on Monday to ramp up their construction plans as his administration rolled out a guidebook for accessing the nearly $1 trillion made available by the bipartisan infrastructure deal.

Biden welcomed governors to the White House on Monday as part of the winter meeting of the National Governors Association, and he cajoled them on the importance of infrastructure.

“You know how to build roads and bridges,” the Democratic president told them. “Well, we got a hell of a lot to build.”

After the meeting, a pair of governors described infrastructure as a place for bipartisan cooperation and stressed that it was important for states to be able to spend money as they see fit.

“In terms of the infrastructure, the magic word from the governors is give us flexibility, hold us accountable, but we know how to invest in infrastructure and, trust us, and we want to partner with the administration," Arkansas Gov. Asa Hutchinson, a Republican and chairman of the National Governors Association.

New Jersey Gov. Phil Murphy, the association's vice chairman, said infrastructure was “probably the topic that came up the most, was discussed the most, and where we found an enormous amount of enthusiasm." Murphy added that he would “underscore” the significance of "flexibility ... in terms of how the monies can be spent. ”

Mitch Landrieu, a senior White House adviser who is supervising the infrastructure spending, said the goal of the 461-page book is to ensure that all communities have the details on how to qualify for funding, no matter their size or politics.

“It's an absolute road map," said Landrieu, a former mayor of New Orleans.

The book is meant to level the playing field by making it easier for smaller cities, tribal leaders, nonprofits and faith-based groups to compete for money that usually only lobbyists know how to access. The infrastructure deal is unique in its scope as it goes beyond roads and bridges to include such initiatives as broadband internet, replacement of lead water pipes and resilience against climate change.

Administration officials assembled the guidebook quickly as the infrastructure package became law on Nov. 15. Copies are available online at build.gov, though the administration is working with associations and direct contacts to make sure it reaches government officials in communities of all sizes. Landrieu said he has already spoken with 43 governors and more than 250 mayors as part of the push.

The infrastructure package includes 375 distinct programs, of which 125 are new. And while the guidebook is more than twice the size of the F. Scott Fitzgerald novel “The Great Gatsby,” it's considerably shorter and easier to navigate than the infrastructure law, which stretched for more than 1,000 pages.

About 60% of the funds are available through formula and 40% through competitive applications. Not all the infrastructure money is able to go out as the federal government is operating on a continuing resolution that runs through Feb. 18, instead of an annual budget. Still, not all of the money will go out immediately as the programs are generally operating on a five- to seven-year timeline.
