I doubt this will go anywhere; if you want to get picky her channel is called 'Amberlynn Reid' & a quick check of Social Blade shows several variations of Amberlynn. Is she sending legal snotgrams to everybody using Amberlynn?

Avoiding double posting: Is the old porn star's TM applicable to ALL media & other, similar uses of the name?
From IMDB:

Amber goes by Amberlynn, not "Amber Lynn", which is what the geriatric whore has trademarked. Regardless, Amber's actual name is Amber Lynn, so I don't think the porn star would get very far, but she should absolutely try.

On a funny note, I wonder if either of Amber's parents were fans of the porn star, which might have influenced their name choice for their daughter. Her career began in 1983, it's very possible at least Amber's father knew of her.

Can't blame the old roasty for being a haydur, though. Who wouldn't be mad if they ended up looking like this?

She looks like she used to be a guy. :story:

I googled this creature and her late brother was also a porn star (Buck Adams)! "Lynn's mother suffered a nervous breakdown, and Lynn was placed in foster care, where she was physically abused."

Amber Lynn sounds just as fucked up as Amberlynn. They should have a long talk. :c

Technically a trademark is only protected form infringement if used in the same field, as there might be malicious intent from the infringing party that might want to trick customers into using their products exploring the trademarked conpany’s name, but unless Fat Amberlynn want to open that layg revealing Parreon/OblyFans there shouldn’t be any infringement, as the ancient slut is in the porn industry and Fat Amber is (inexplicably) in the entertainment one.

Not sure whether anyone else has mentioned this, but it just occurred to me, maybe Big AL changing her name back is to try to create drama for her channel? Hopefully, Crotch-Rot-Lynn will just ignore Big AL, so she'll be back showing us her candles and cushions...
Funnily enough, they’re both Crotch-Rot-Lynn, but for two completely unrelated reasons

"Eating candy on camera", the one with the orange peel, and "eat with me | Cheesecake Factory" are the most vile thumbnails, imo.

This is a great compilation of images though. It really shows how dead her eyes are, even when trying to look surprised or quirky. She's so fat she can't even make a wide eyed look. Amazing.

Good lord. Now these are the headshots for casting calls to Dr. Phil for an intervention. Anyways, why does it look like she is trying to replicate Avocado’s thumbnail and clickbait titles.

I hate to say anything in defence of our hamburglar but it would be amusing to see what basis some dried-up old whore has to take somebody to court over using what is essentially her own name as her own Youtube channel.

Essentially isn't the same as her real name. Essentially doesn't let you squat on a legally registered and restricted trademark. If my parents named me Coke and our last name was the Cola family, unless my middle name starts with an A I'd be laughed out of court if I opened up a soda store and called it the "Coke, A Cola" shop when the soda company decided to put me on notice they don't like me infringing their brand. Amber's only bitter because menopause got her way earlier than it did her porn actress namesake. But it would be hilarious if it went to court, especially so when Amber lost the case for infringement and was ordered to pay her cash from youtube ads that boomers don't know how to block to the public figure damaged by her market confusion causing use of the mark, on that, we agree, just from opposite spectrum ends.

The restriction only will be valid if there's effort to enforce it, if you stop trying to promote a protected property you can actually lose your rights to protection of it since you will be considered to have been abandoning your attempt at protecting it and thus don't need the market barriers to others use of the name/brand/design/whatever you have covered enforced on them.

Or, the rights holder to the mark can open a youtube channel and say this is my brand and the confusion caused here is doing my brand harm so courts, step in and spank fatty. There are plenty of ways this can game out, unlike the channel rebranding, which can only end in failure and pork tears.

That's the thing though, a name is very different from a multinational company famous for tooth-rotting soda drinks. The ancient whore known as Amber Lynn isn't the only person in the world with that name and going by any given game, there are dozens of variations on how to spell them. Catherine, Katherine, Amber Lynn and Amberlynn; it would be impossible for a court to convict Hamberlynn for having a well-known channel based purely upon her name or mispelling of it. If the Aldi/Lidl down the road can get away with selling knock-offs based on popular brands of cereal and other product, no court in the world is going to waste money and time convicting some fatty on the behalf of an old two-bit whore who looks nothing like her anyway.

Edit: Spelling was shit.

I love irony, but there's no nuance to this at all. A filthy pig who never showers or washes her hair has turned a bathroom into her vlogging studio, while her views will ultimately go down the toilet.

Except, here, the name is the brand (insert 'namebrand' pun here, actually don't it's pretty obvious if you have to resort to crying about the registered trademark being unfair to a true and honest name that isn't a true and honest name for the supposedly aggrieved party, we're now firmly in straw clutching mode to compensate for no argument) and one of them has the registration and is interested in enforcing it and the other just wants to let the bingemonster feast without consequence so I'm pretty sure the odds are stacked against the latter just on determination alone before we even get to mark rights enforcement. Also, she's not going to even try and get around the registered term by going with the sly attempt at calling herself totally different and not at all market confusion causing spellings like 'Ahmber Lynn' or 'Amber Linn', she's straight up using the registered mark after being both told not to and changing her channel name because she was aware of what she was doing, She tried harder at losing weight than she did standing up to legal notices and succeeded just as much to this point at both. Courts waste time and money all the time too so good luck with the denial of what they will and won't hear, just look at how many lawsuits Russel Greer files and type that last sentence again if you can dare bring yourself to do it.

This could be fun if the porn star opened a YouTube channel and stared uploading mukbangs and Target hauls that got more views than Amber's.
