Right, consent isn't a factor in the crime of incest. But it would be a factor for rape charges, which will be a much more serious crime. He might be able to plea out and get probation and a non-contact order if it's just incest... rape is a whole different outcome though. That could actually result in hard prison time.

What I find really sad is how a vulnerable, eldery woman was raped by her own son - and has been abused in many other ways by him for years - but hardly anyone offers a thought for her.
