There's a tiny bit of merit to that, in that Tolkien was still tweaking and reconsidering things until he died. There's stuff about Galadriel's involvement in certain early history events he was still workshopping till the end, and the Blue Wizards didn't get any development in any proper work, but he later wrote down some info on them TWICE, the latter overwriting the former. Some things he was still struggling with, like the nature of Orcs, and only ever talked about them in letters.

But none of that is what TROP had the rights to, they only have the appendices to LOTR, so they can't really use it as an excuse.

Doesn't matter. Nobody buys it. If it didn't come from Tolkien it isn't canon, whatever piece of shit owns the so-called intellectual property. Their "canon" is garbage and I shit and piss on it.
