For the purposes of this Notice, the eSafety Commissioner will accept ‘geo-blocking’ of the Material in Australia as substantive compliance with the removal requirement of this Notice. Geo-blocking refers to the practice of restricting access to, or delivery of, online content based on the geographical location of an end-user’s IP address.

Dear eSafety Commissioner,

Lolcow LLC, doing business as Kiwi Farms, is a business entity incorporated under the laws of the State of West Virginia and conducts its operations exclusively within the United States of America. We have no offices, employees, assets, or other business nexus in Australia or any other jurisdiction outside the United States. We do not concede that your notice creates any enforceable obligation upon us under Australian law.

Regarding the material identified in Attachment A (the Niggercell Manifesto authored by Solomon Henderson in connection with the 2025 Antioch High School shooting), we note that this document is directly relevant to a matter of significant public interest within the United States, the jurisdiction whose laws govern our operations.

The Federal Bureau of Investigation has classified this category of material as an example of Nihilistic Violent Extremism (NVE), a recognized threat typology that the FBI actively studies and publishes guidance on. The preservation and availability of primary source documents of this nature serves a legitimate public safety function: it assists researchers, educators, parents, and law enforcement in understanding the ideological language and behavioral indicators associated with NVE, particularly as it affects young people. United States law recognizes and protects this interest.

The legal framework under which we operate reaches an opposite conclusion from your own regarding the preservation of this material. The principles underlying your notice and the principles underlying the laws that govern us are, in this instance, irreconcilable. For this reason, we are unable to comply with your request.

Your reply was considerably more polite than the one you gave NZ.
I think the fact that the takedown request literally contained the words "Niggercell Manifesto" brought Josh some joy as he was responding to it. He probably wrote the response with a giant smile thinking about how he was going to feature a post about a sovereign nation requesting the takedown of the Niggercell Manifesto.
