Because if you have to force it at least one party is not being reasonable and is NOT going to go along with it. So both sides end up spending tens of thousands of dollars on some completely worthless mediation that is never going to result in shit, and they also have to pay the mediator for wasting everyone's time.

LUS is a retard and FORMER patent or IP (forgot which, too lazy to look it up) lawyer from Australia, his opinions on legal US topics are about as relevant as a wet fart in my opinion.

He really glomped onto the Karl topic trying to become relevant as some Aussie lawtube persona, but his history is a failed trading card game company speculating on the TCG market, plus is autistic "I now have a girlfriend" talking in the past make him highly suspect as a source.

Hiring local counsel plus specialized pro hac counsel is a signal of more money. While Missouri is a third-rate state, it does have St Louis and Kansas City -- which surprisingly do have some reasonably good legal talent (Shook Hardy and Polsinelli come to mind immediately). So it was a choice to go with the California team plus local counsel. I guess the three defendants may have some kind of joint defense arrangement -- ignoring what could be problematic conflicts issues -- and be pooling money.

It's all so dumb. You know damn well these judges don't want to actually expend effort on ruling on motions here -- they expect a settlement, and might put everyone through the ringer trying to force a settlement through mediation. The judge I clerked for had an, in my opinion, naive expectation that "if i just don't rule on the papers, and push them towards more mediation, this will all just go away because it is so obvious" -- and he did that for a case involving a trucker for an out-of-state oil and gas company clearly at-fault killing a bystander, where the amounts at-issue were significantly higher than anything at issue here.

Until the three amigos get a clear adverse ruling I think they'll continue huffing copium about it all.

Of course hiring extra lawyers means extra money, but I would assume Kacey is to dumb to hire her own counsel and relied on Denims to get the same lawyers, who then organized for local counsel.

Frogan got her own more boutique LA firm, she is not in the same boat with the other two.
Overall she has been the one who handled the situation the best.
She STFU, deleted all content to avoid causing further harm, and got a lawyer without a conflict.


Denims and Kacey likely have their shared defense arrangement, but I would be surprised if they had pooled their money.
The 40k$ should last Kacey through mediation, but she knows already that she does not like what the Mediator will suggest, and her lawyers already told her what a fair settlement would be. She seems to think she has a chance in court, because she is too stupid to understand what the final sum will be she will be found liable for.
