In part because Obergefell was not a case about whether the decision on GAY MARRIAGE was legal or not.
It was a collection of different cases which all argued essential damages suffered by people in civic unions (or whatever the name was) due to various state laws and regulations which were only afforded to marriages. It morphed from there into a challenge on state-level bans of gay marriage.
But let's say that it wasn't. Let's say that they just wanted to challenge the old ruling on Gay Marriage as unconstitutional. And that's all that they want - challenge the ruling. I don't think laches apply.
Similarly, if you were trying to argue that these ballots or that PA's mail-in things or whatever violated some element of the constitution, and that going forward it should be reversed? I don't think laches hits you there, either.
It's SPECIFICALLY when your relief involves asking for a stay, an injunction, or for ballots to be thrown out - that's when "why the fuck didn't you do this earlier?" comes into play. It is WHY it's nakedly political. If Trump won, you wouldn't be alleging or making any of these cases. You're free to argue this shit again for the future, where the relief has nothing to do with throwing out millions of votes you don't like.
And it's not just an arcane technicality - upholding it as the law states, trump still fucking loses because those people would be afforded the chance to correct their ballots.
You're not challenging the fucking numbers or the outcome - you're just trying to throw out votes you don't like. You cannot decisively tell me if more than four ballots experienced this problem.
It seems to me like that court just ruled that clerks have, at current, a dubious ability to add in the state initials and the zip-code. Because the court gave no ruling on how to resolve the discrepancy between the guidelines and the statute here. We return to the question of if the state has any need to satisfy retards like you - and we return to no, it doesn't.
Indeed the state doesn't know how often this occurred, because the state did not find this to be a violation; the court has demurred on resolving that topic in particular, leaving it in a gray zone. That would be why you would need to first argue a case PURELY on that topic, whose relief is simply to get that codified and to compel a further audit into the definitively-improper ballots' existence.
You literally fucking admit there that you aren't bothered by something not following the line of the law if Trump won.
The republicans should have been all over that shit, because this isn't a -political- effort at all! It's about laws, like you said! And indeed, they could have made that case without running into laches, given that they wouldn't be trying to overturn the results of 2016 by the effort.
