Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

Holy shit! I’m dying! That’s even less than the GFM money. That’s like the ultimate slap in the face! 😂

The GFM goes to Vic's lawyers who have probably drained it already. Nobody knows how much is left in the GFM because no receipts about where the money is or how much has been spent have been provided. Maybe someone should ask Nick Rekieta about that? Nah, why would anyone want to know where a quarter million dollars has gone. Totally unimportant.

Vic has said he can't access the money so everything he owes to the defendant's will be coming out-of-pocket.

Half a million if the Appeals and Supreme Court don't think the case has enough merit for oral arguments, it goes down to more the courts review it (the more merit it has even if they still side against Vic), attorney fees for Appeals are ruled in with the final judgment.

So if both the Appeals and Supreme Court take the case and decide against Vic is half a million.

Honestly, it's better than expected. 10-20% reduction was the going guess, so more than 50% on some cases is significant. Probably a sign that Chupp is settling in that this isn't going to go away and he should start paying attention.
This is making me slide into camp "Chupp was just fucking AWFUL at TCPAs". His stuff before the TCPA was strong, slapping down any tomfoollery from both parties. This ruling is in line with what he should do having granted the TCPA while also showing he can do his job.

Not fully in that camp, but leaning towards it.

You forgot to put on your tinfoil hat.

No files of Vic's fees have been released because he's the plaintiff and not the defendants petitioning for sanctions and attorney's fees, you brain-dead law twitter mouth breather.

July called, it wants its talking points back.

How would Nick know how much Vic's lawyers are billing him?

Man, I really hope you're someone's alt. If not: which country's educational system has failed you?

Win WHAT? Racking up more fees in the pursuit of repaying their old fees that were ridiculous to begin with? While also never submitting the unredacted billing the judge asked for? And quite possibly perjuring themselves at the same time?

PROTIP: If you take your soup-eating helmet off to eat soup out of, you have to put another helmet on while you do that.

The judge got the unredacted billing on the 21st. Do you really think Chupp wouldn't have asked for it? Do you really think the Defendants' lawyers were dumb enough to put evidence of perjury in their own fees' filings?

If they had done those things Vic's lawyers would have had a field day at the hearing on the 21st. Hsu isn't the incompetent buffoon Ty Beard is.

They should, there are good causes on MoRon and Funimation that required Chupp to outright ignore/be unaware of evidence. Marchi is more... difficult. Personally, I'd have never added her to the lawsuit to begin with.

I think Ty said it on one of Nick's earliest streams after the case was filed. Marchi was always the weakest case, but she was included to paint the totality of the picture the case originally made: a FUNimation-centered circle of people who were in close contact with each other, who defamed Vic publicly and privately, and coordinated their public actions accordingly.

Defamatory or not, Marchi clearly chimed in to bolster the Vic-as-predator narrative right along Monica. Her status as a Funi VA made it so if she was left out, the first question MoRonica would be asking is, "well why are you only going after Monica and not these other people?" They tried that in this case anyway, but notice Vic had a solid answer of "my friends' statements had the most credibility, and I'm going after the most damaging people".

We already have the e-mails from Monica to Funi HR talking about what she could say publicly, and Ron's Kamehacon texts. I think if proper discovery had been accomplished, BHBC would have found something to hang on Marchi too... but the TCPA frustrated that.

Didn't they forget to redact the whole Funimation is Casey's client?

They should have waited to add her in until after discovery. You can add people to lawsuits after the fact.

There is enough for Marchi to pass TCPA. You have her talking about how he abused her, and then initiating fake makeout sessions in front of fans at a convention.

You have a defamatory statement, the damages, and even enough evidence to prima facie suggest that she does not believe her own words, because why would you do that with someone who you believe sexually assautled you?

Are you checking off the Lawtwitter talking points chart? Did they give you a script like they do for telemarketers?

Or do you believe people that don't actually get work?

Calling your co-defendant your 'ride or die' should have signaled the conspiracy alert too.
