That’s assuming that all the emails and correspondence hasn’t been torched. Then again, if Ron is any indication, they may be arrogant enough to keep everything.
The beautiful thing is we (and by the extension the defendants) don't know what Ty does or doesn't have. Remember that one RoosterTeeth chain mail that somehow made its way into Vic's hands? The "no one talk to Vic" one? I bet no one at RT expected Vic to have it, but he did.

Same thing here. What if someone Sabat's been forwarding things to is Nick's secret source? And then it turns out Sabat deleted those messages (already in Ty's possession) in contemplation of a lawsuit? A jury will sniff out that bullshit real quick.

It gets better if Ty gets enough leaks that he can just subpoena their email provider.

Yep. There might be plenty of ammo left. Getting an opportunity to use it is the problem. I think they kept the heaviest stuff in reserve because it will be nuking a bridge and the surrounding county for the source instead of Huber's pussing out.

The issue with this is that while Funimation uses 'we never said that' as a defense, they also use 'but it was the truth' as a defense, given that they also have Tammi saying 'we did the investigation, I found these accusations, and I found them credible'. So they're basically saying "We never said or even implied that Vic did anything wrong or that we fired him because of that, but coincidentally we did find that he did wrong things and fired him because of that."

You and they mustn't have been paying attention because Vic outright said in the depo that the person who sent it accidently copied Vic into it.
 
At this point, I feel like Vic isn't going to sue anyone after the trial with Funimation, Monica and Ron and Jamie is over. By then, the statute of limitations will be over.

Which sucks because I was really hoping for Vic to sue those shitty rags, ANN and io9, Marzgurl and Sabat.

No doubt Ty and company had hoped to be able to conduct discovery before doing that but there is still nothing specifically standing in their way from pulling the trigger on it beyond time and resources. Which could be a major obstacle.

Which doesn't change the fact that, whether secretly given or mistakenly sent, they wouldn't expect Vic to have it and risk a negative jury inference if they deleted it.

I mean, now they know since it was featured on Nick's show and was in Vic's depo, but at the time they wouldn't.

It's moot since they're not being sued, but the same reasoning applies to any communications to and from Funimation.

Why would a federal court have jurisdiction to hear a suit between Vic & Sabat?

One plaintiff and one defendant in the same state are enough to defeat diversity jurisdiction.

As An0minous pointed out anyone suing in Texas should have expected a TCPA hearing and at least 1 appeal.

Between BHBC and Martinez & Hsu they should have planned for it going past the statute of limitations.

Maybe they will wait til January, file a suit expecting Sabat to drop a TCPA quickly and then appeals. By then Monica, Jamie and Ron will have been decided by the appeals court.

Not sure if you can have multiple suits going on about the same tort but smarter minds than me will explain it.

One of the reasons I would have liked to see ArmzWhore sued. The other parties would have probably told her to fuck off.
If discovery starts could BHBC subpoena non parties like Marzgurl for communications with the defendants?

What he actually said was 'it must have been by accident'. Vic has no idea why he got the email, and it happened after a delay when no one was answering Vic. It might be an accident, or it might not have been.

Nah, he chose the MeToo route and is a creepy sexual deviant worse than 20 Shanes/D.C. Douglas' put together. He needs to be taught a lesson. That and I want him to so scared he does a flip. Sex pests like Chris Sabat need to end their worthless lives.
