If the judge said anything to create that impression, that isn't just an appearance of impropriety, it's actual impropriety.

If the case gets thrown out that'll be something of interest.
Because that'll strengthen the appeal I would think.

Mediation won't extend deadlines, which is why it's unusual for mediation to come up at this point in the process. The TCPA deadlines are absolute. If you miss the deadline, you better have a very good reason for it and hope the other party is willing to let it slide because it would be a major prejudice to them if you go after the deadline.

It would be a hoot if the judge doesn't know this and inadvertently blows a deadline that causes the motion to be denied.

As funny as that would be, it would create some actual issues for the judge if that happened. Missing a deadline causing major prejudice to the defense? And I'm not even sure you can successfully appeal a TCPA that failed due to a missed deadline by the judge, because missing the deadline and then still having it potentially tossed would be prejudicial towards the plaintiff instead. Appeal courts might not like the idea of that either... It would be a mess at the very least.

It's already a mess and unless mediation somehow magically gets everyone toasting marshmallows and singing kumbaya, which fucking Mr. Rogers with the power of Jesus couldn't accomplish at this point, it's just as well it be an immediately appealable mess.

If the TCPA items were going to be dismissed, he would have done it already. I can guarantee this means it's going to the appeals court if mediation doesn't work.
 
A judge getting death threats? I sure hope someone doesn't mention one of the defendants doing this in the past or that the defendants have secret groups where they co-ordinate attacking people.
