She's not doing that, either. She denies that the children should haven taken responsibility for what happened to them (because "they were too young to be expected to do that"), but she does say that the children must have expected the molestation at some point and given everything including that, she suggests that there may have been some measure of consent in these incidents (she figures the guy was thinking like an Ancient Greek man-- never mind the Greeks loved yeeting babies off cliffs if they didn't want them and we should probably have more discretion when it comes to appropriating Ancient Greek attitudes if she's right).

I think an issue here is that she extols our age of consent laws without understanding the rationale behind them, which is simply that we have no reliable way to determine if a child meaningfully consented to sexual relations with an adult, much less an adult who has authority over them given their lack of life experience, and we have no reason to exert effort in even entertaining the thought that they did (especially when the adult is directly in a position of authority, and the likelihood of blackmail is then introduced into the equation). It's because of that rationale that she can't speak about children meaningfully consenting-- it doesn't matter, they might as well not have.

I figure the reason she phrased all of this the way she did was because she couldn't think of him as just another pedophile, firstly because she knew him and secondly because she wanted to jump his bones at the age of those victims. But she's definitely fully aware that what the guy did was wrong, she's fully aware that those boys were victimized, and she's not blaming the boys for what happened to them (though she entertains the thought that may have been some kind of consent in these encounters).

Hmmm...I'm not a law but that seems awful quick considering they have 60 days. I don't know who it is that normally post these for the rest of us but are we going to get it and have a date for next week or two months time?

I don't know that system. But the TCPA deadlines are a maximum, not a minimum. A judge can easily decide the process, which is supposed to weed out frivolous lawsuits early in the process, should be handled in the swiftest manner possible.

I personally would completely approve of such an approach. The sooner the hearing, the better.

I'll have more of an opinion if we know an actual date. If he just up and set a date 60 days out I won't be as impressed, but I will be impressed if he's basically okay, next week, let's do this thing.
 
That's actually an interesting procedural issue. Does it stop all discovery? Does it stop only discovery performed by the party against whom it's filed and the one who filed it? Or is it more flexible than that?

And does the exception apply strictly to discovery related to the TCPA itself? And if so, can the stay exception apply to a party who is seeking discovery despite having no pending TCPA motion of their own?

And even if it is somehow related to the discovery, how much discovery is enough? How much discovery is too much?

Part of the whole point of the TCPA is to protect parties from having to undergo the burden and expense of frivolous litigation, but discovery is a lot of that expense, and that's why the TCPA even has an immediate stay provision.

The law hasn't answered all these questions adequately, which means these parties may be responsible for generously helping it out with any precedents that end up set about them in this case. Oh joy, for everyone involved.
A question I have as a dumbass layman is what happens to discovery documents that are super late and gay? MoRon have no intention of handing over the rest of their discovery that is now 23 days late without being forced do by the motion to compel.

Probably. I mean, he was dicked around through the confidentiality wanting, and Casey apparently, through being at the mercy of Ron & Monica, is STILL holding the legal proceedings hostage by not giving everything for discovery. Part of me feels bad for Casey. I feel like he tries to get Ron and Monica to not do...whatever their plans are, but they double down on doing it and when they leave he goes to a supply closet or the bathroom or just sits in his chair and curses the air wondering why he’s representing a pair of idiots. And a receptionist or an intern has to tell somebody that Casey’s fine.

So she's kinda saying the victims wanted it? Even if she the slightest bit implied there was consent there, that's still saying the victims wanted it

Considering the TCPA makes or breaks FUNimation's involvement in the lawsuit it in the best interests of everyone that the matter is resolved quickly, either FUNimation win this and get to abandon these chucklefuck VAs to their fate (I give it a 40% chance this happens) or they get to sit on the lollercoaster with the VAs and watch as the people who they failed to tard wrangle blow this case for all of them.

FUNimation have already shown they intend to throw anyone and everyone under the bus to save themselves, which means the fun stuff really starts once we know if they're still on the hook or not. Even some crazy cat lady fujoshit is now under the wheels because of them. Monica must be pissing herself right now with how much weight (heh) they put into her parts of the investigation.

In the case of Nick and other correspondents, the discovery part isn't as important at the moment as purposely doxing people associated with Vic out of frustration and anger seems to be the strat.

That’s likely to happen before the TCPA hearing. Remember this hearing is between Vic and Funi. There is still a motion to compel and possible sanctions regarding Casey and MoRonica. And for all Casey’s whining about wanting confidentiality in e-mail with Ty, he filed nothing to delay his discovery requirements. He didn’t even discuss the issue until past deadline. He still has not presented anything to the court on that matter. Funi’s TCPA May halt discovery for a few weeks, but Casey was almost a month late when Funi filed. The judge will not be happy.
