Sure it's been said but I want to reiterate. Why does he keep trying? Is it slinging garbage at a wall and hoping it sticks or is he ascended to a new level of mentally ill beyond that? I can't agree with those who say he's a broken man as he's so deluded that he clearly believes he stands some chance, which is also questionable with the horrible choices in lawyer and target he has made. Who is encouraging this man? If nobody then what? Doesn't he have something to lose?
I'm starting to genuinely feel bad for him and have been praying in my seminar that he gets detained by the court or something and gets the mental help he needs.
I'm curious whether Maddox's lawyer has even filed an appearance. I assume they have, since they filed for an extension. If they did, they can't duck out so easily; Asterios's theory that they are only there to do the filing is unlikely.I don't know. Anyone actually seen this filing for an extension? No. This is partner tier legal fees even in New York. There are a few lawyers who charge in the realm of $2,000 an hour or more, but these are very few and far between, and you'd recognize them because they're named partners of famous firms.
It is shocking and unconscionable for an incompetent hack like LanDUI who files atrociously unprofessional garbage that reads like he wrote it on a drunken bender, which is probably what he did. No court would award him fees anywhere near that.
Also, lest I be accused of hyperbole, I'm not exaggerating in the least. Read what the judge said about this crap. He literally described it as so unintelligible he couldn't even figure out what it was supposed to mean.
Yes. To find malicious prosecution, the court would have to establish not only malicious intention, but that the action was brought without probable cause, and that it is dismissed in favor of the victim. The second element has yet to be established, and obviously the third hasn't happened yet. I think it is a possible outcome of this suit, but Asterios acting as if it were a foregone conclusion is premature at best.Not a legal mind, but whatever.
It's prime "Gotcha!" material, to be sure, but if someone's words coming back to bite them in the ass was equivalent to an admission of guilt, the law would be very different.
EDIT: The standard for malicious prosecution of a civil tort is forbiddingly high in New York. In Perryman v. Village of Sarnac Lake, the Third Division of the Appellate Department found that the plaintiff in such a case must show "an entire lack of probable cause in the prior proceeding," citing Engel v. CBS. I think Asterios has a case, but it's not established at this point that he does.

Someone said LanDUI was still going after Maddox even though they agreed to somethingMaddox doesn't owe LanDUI anything. LanDUI ate up his retainer (estimated to be something like a $30k advance for an Amazon pilot that went nowhere once they had to actually work with Maddox), didn't even make it through motions to dismissed. The money LanDUI asked for was just a threat, to get Maddox to let him out of representation, LanDUI hoping to be able to jump out of the way of the sanction train. The agreement to ended representation dismissed those costs.

So youre saying hes using a credit card to pay himself though Patreon to get hard cash because he doesnt have said hard cash to pay his lawyer? That sounds too smart even for MaddoxOne theory is that he's maxing out a credit card to pay his lawyer. Since this would be an easy and unbelievably stupid thing to do I think it might have some truth to it.
