The going theory is a "deathmarch to Trial" where the appeals told them they have to hear it, so they don't want to dismiss the case for ANYTHING until it gets heard on its merits, and that means trying to hammer this lolsuit into a normal case shaped hole. Mum's the word on any Greer misconduct Hardin reports, and mum's the word on any of Russell's crazy shit like trying to disqualify Hardin, because that's lolsuit shit that won't get the merits to trial.

But with this counter claim, no matter how or when the copyright case concludes, there's no longer a big pile labeled "to be mooted after trial" there WILL be a conversation about Russell's misconduct and his baseless claims against Hardin, and they WILL have to either give Null the win or go on the record siding with Russell's insanity.
