It's hard to believe this was orally argued. Judge Stras writes a good dissent but Rodriguez v.United States, which the Eighth Circuit cites, is fairly on-point. You can't hold someone for longer than reasonable when you pull them over. I assume the law in the state didn't allow the cop to tow the car, because that would have been the obvious move in order to get an inventory search which would have retroactively legitimized the dog sniff via the inevitable discovery doctrine.
