Huge fan of Hardin's approach here. The judge hammered Greee for his lack of effort to uncover his eager witness had died a while ago as well as Russ's inability to check emails from the court. Now, not only can't Greee be bothered to respond to repeated emails in a timely manner, much less at all, but doesn't even care enough to read the email when he finally responds. Hardin is building the narrative over Russ (excusably) neglecting his involvement as a party in this court case, and ultimately his severe lack of prosecution.

Greer will definitely file his opposition an hour late again now that the precedent has been set.
 
Without Greerhelping, is the sex worker's testimony so valuable as to change venue?
I get the move back to Florida, for obvious reasons. Ohio, less so.
If it is moved to Ohio, maybe we can retain the illustrious @Potentially Criminal as a Victim Advocate, with plenty of private backroom discussion.
I'd assume he'd only file it if MtD is denied for trial purposes

This fresh barrage of witnesses is the absolute fucking best. Excited to see what Amazon have to say and any evidence regarding the forged letters if the case ever gets that far.

It's a fantastic look for the guy doing the suing to tell his victim's representation to "stop fixating on the case" and repeatedly ignoring important communications. Very "excusable", bizarrely.

I like how Hardin is using the court's own order (in part disagreeing with Defendants) from 150+ filings ago against Greer's newest arguments.

Mr. Greer states he has never before sought sanctions under Fed. R. Civ. P. 37. But that’s transparently false and shows only how cavalier Mr. Greer has become in making untrue and unresearched allegations of wrongdoing against undersigned counsel. This Court’s docket reflects (as Mr. Greer’s own memory should also) that Mr. Greer sought sanctions under Rule 37 at ECF No. 263. That motion was denied, with the Court expressly holding that Mr. Greer’s motion was filed under Rule 37. ECF No. 272 at 5, n. 18 (“The court also notes that, contrary to Defendants’ assertion, Mr. Greer’s motion for sanctions was brought under Fed. R. Civ. P. 37(b)…”).

Even without investigating Greer's actions, keeping the case in Greer's face is a good strategy. Greer is pretty content to let the case simmer in the background forever, as seen from the times that he just ignores it for months and then files a motion to undo the thing that just happened when he finally looks. He's lazy and forcing him to stay engaged just means Greer will get more and more frustrated. Probably won't get him to drop the case just to be rid of it, but enough to make Greer keep fucking up catastrophically.

I'm curious if the reason Russ forgot he's attempted this type of sanction before was because he's a retard, or ChatGPT wasn't aware of it and Russ glanced through without catching it. Obviously, the former is a safe bet, but the latter is really, really tempting.

Whilst I initially wasn't sure why Hardin would propose a venue change to Ohio, it would make sense should Natalie Banks be eager to testify.

That being said, sending the case back to Florida could also work, preferably to Judge Bozo who bounced it back to Utah. It'd be a just punishment for him.

I suspect this is more Hardin making a point than any actual desire to start over in a new court. Of course I could be wrong.

It does come across more as needling Greer and the Utah judges, the former for his retardation and the latter for their refusal to act. I can't imagine any way in which moving the case to Ohio would even be seriously considered, much less considered an actual good idea in real life. The pseudonymous hooker's potential testimony isn't going to be particularly helpful, although her sheer presence in the email exchanges between Hardin and Greer is itself causing our Plaintiff to shit himself most hilariously.

I cannot understand how Greer doesn't understand the relevance of Amazon's information in a COPYRIGHT case.

Anyone with 0.00001% of a brain would realize that you need to show how the alleged infringement impacted sales(or in this case made no difference at all). And really this should have been a disclosure Greer made, along with every other location his book (wasn't) sold.
