I was in a place where they got little rain and the houses I looked at just discharged the downspout water right next to the foundation and obviously there was some undercutting there. Sounds like that builder may have done similar and not properly planned for runoff and simply ignored the fact that sometimes it really does rain, a lot, even in a desert.
Thankfully it's an add-on pad on the side of the driveway leading to a car-sized gate into the back yard, and they don't use it, so at least there's that. I'll let them know not to drive on it though. I'm sure you're right -- they'll have to redo it. The pisser is the local telecom just ran fiber under there (well below the pad -- it was like this before they started) so replacing it's going to be a "fun" job for whatever contractor I can convince to do it.
