In the Massachusetts SNAP case (Half the Country v. America), the judge has given the USDA until Saturday -- tomorrow -- to file a response to the plaintiffs' newest motion.

Kinda wild that this lib judge has still not just granted the demanded TRO, but maybe she actually learned a lesson when SCOTUS overruled her previously on the deportations and doesn't want to be humiliated again.
Plaintiffs (half the states) filed a supplemental notice yesterday, pointing out the activities of the Rhode Island case and how SCOTUS issued an administrative stay on that. The plaintiffs in
this case seem primarily agitated about the possibility that USDA might end up charging them for any fuckups they make while the litigation drags on and they attempt to navigate the
oh-so-complicated math of only distributing 65% of people's bennies this month.
Also yesterday, defendants (America, USDA, Secretary Rollins, etc.) begged for the upcoming in-person hearing to be converted to a remote hearing, because it's heckin' inconvenient especially now what with the government being shut down and flights being canceled right and left. They sloppily fawn all over the plaintiffs in the case for ever-so-graciously not objecting to this request. The full letter from the lawyer is really quite pathetic and embarrassing, featuring a lengthy sob story about their airport adventures last time they were forced to appear for an in-person hearing.
Also also yesterday, defendants filed their response as ordered to plaintiffs' renewed demand for a TRO and preliminary injunction (neither of which, I remind you all, this judge has yet granted, oddly). The document is 27 pages, and features a lot of citations as well as references to the ongoing Rhode Island case. A few highlights;
Remember, this judge (and I believe the Rhode Island one too) expects USDA to
divert money out of child nutrition programs in order to fill up the Skittles and Fanta EBT cards across the nation. USDA is disinclined to do so.
They also have thoughts about the "hold harmless" demand.
TL;DR: The USDA is calling bullshit on the whole thing.

amici curiae brief there.
Evidently, several states decided to immediately assume full SNAP benefits were coming and didn't take a second to think maybe the USDA would appeal the bullshit Rhode Island ruling...
Whoops. Anyway, in the words of the immortal Russell Greer, they demand the courts to undo the thing (stay) that was already done and get back to gimme dem gibs.
