I just want to say- I believe Oliver Bromke, undergrad Rutgers in Journalism, and then a law degree from Rutgers, has the ability and NYC connections to write and publish the Rekieta story. With Hardin doing the FOIA work (and maybe getting a co-writer cred), I foresee a New Yorker longform article, and concurrent book publishing.

It's sort of funny the county is pulling this crap and didn't think to notice that Hardin has already been in MN state court 4 times for the state withholding information. Looks like all 4 they came to an agreement but he's already been down this road in MN. And then you do a federal case lookup and noticed you may have tangled with the wrong guy.

This makes a lot of sense. There's no grounds for Rekeita to sue if they did everything they could to resist releasing the video, but the court ruled they had to. As far as they know, they have nothing to lose by withholding it.

Most people would give up and go away rather than pursue it past this point (Null and Hardin are not "most people"). It's like requesting to be relieved of jury duty; the Court rejects 100% of first requests, then grants a certain amount of need-based second requests, because a lot of people will give up and serve after their initial request is denied, and they probably didn't really need to be excused if they didn't appeal the first rejection.
Yes, exactly. Since there was a seemingly plausible claim (presumably by White) that the recordings weren't supposed to be included in his submissions for acceptance into evidence, the County and the Court could say, yeah, not accepted, and not touch the question of "presented" - leaving that for someone to establish by suing.

The law is hard for the everyman to understand, and that's just the way they like it. Nick is not alone in his belief that he can pilpul his way out of anything by saying the magic words; he's just lulzily bad at it.
Law is hard because it is aims to be very precise yet broadly applicable, but laws can't anticipate every fact scenario, so what "is" is gets interpreted by humans in ways that can both expand and contract common-sense deductions - because "common sense" changes over time, as do judicial sensibilities - and due to precedent, the bounds of judicial interpretation can be cordoned as well. That's often frustrating, especially for people looking through a lens of, "well, I read that law like x" or "it should be like y."

There's a strong case to be made both ways. Ethan Ralph beat a woman and abused a baby on recording, whereas Nick has only allegedly beaten his wife and kids. At the same time, Nick has emotionally damaged more people, and Ethan Ralph mainly hurts himself nowadays with his family far away.

Deleting the footage now would be illegal, full stop. There’s active litigation and a formal records request on file. Nick Rekieta and the prosecutor don’t get to hit delete just because the footage is inconvenient or embarrassing.

Hardin requested the bodycam footage on April 22nd. The court partially granted his request on May 1st, allowing him to view the footage in person at the courthouse. Despite this, the Sheriff’s Office has stonewalled every attempt to obtain copies, even after being told by the Minnesota Commissioner of Administration that this footage is classified as public data under state law.
Things escalated after Hardin sent a civil demand letter on May 23rd, warning the county to release the footage by June 1st or face litigation. In response, the County and Rekieta’s defense rushed to court and obtained a retroactive order declaring the footage was never evidence—filed and granted in less than 24 hours, and without notifying Hardin, even though his request was directly impacted by this move.

This isn’t subtle. The motion and court filings all but admit the goal was to block Hardin’s access to the footage. The footage had already been submitted by Rekieta in his Motion to Dismiss and was referenced in his legal arguments. On August 21st's hearing, the prosecution even stated on the record that they would not agree to exclude all body camera footage, indicating the state intended to use it regardless if April's post-mirandized statements could be used or not. Nick and his counsel demanded the footage in discovery, and it was provided to them. Now, after sentencing, the claim is that it’s suddenly not evidence in the case?
It’s in the record. You can’t just memory-hole evidence because it’s inconvenient or embarrassing after the fact.
Other than active criminal investigative data, data collected/created by body cams are generally classified as private/nonpublic and the data that are not active or inactive criminal investigative data must be retained for at least 90 days. (§ 13.825, subd. 2, 3)
Lastly, they are also legally required to maintain this data for the duration of Nick’s probation, in case of any violation. This ensures due process and preserves his ability to challenge the conviction or defend against alleged violations. Deleting it now would amount to spoliation of evidence. There’s no legal basis to suppress or destroy it, and every move so far reeks of bad faith. Hopefully, a higher authority steps in to put an end to this disappearing act and holds these idiots accountable. Local authorities acting like little tyrants is the most frustrating thing in the world, and they must be buckbroken.
