Nick should have asked DUIguy because his legal take is wrong. "Legal limit" does not mean you're allowed to drive intoxicated, it's just the baseline for when merely having that BAC presumptively results in a conviction. You can be proven guilty of driving intoxicated at a lower limit.

An officer experienced at determining intoxication can give testimony at trial.
