My point was simply that the fact they actually did find cocaine (something I love to point out again and again) is irrelevant to a FACIAL challenge to the sufficiency of probable cause for the warrant, which they had PLENTY OF.

There are several steps the state needs to prosecute possession. Probable cause for the search is merely one of them.

It's an uphill battle to argue there existed no probable cause when the cops find the very items that they were looking to find as described in the warrant.

The first step in defense for a client is to avoid having to defend anything - i.e. have all the results of the search deemed invalid. And, it has happened where a guilty client - even murderers, drug king pins and rapists - were unable to be prosecuted because the probable cause of the search warrant that obtained the evidence was deemed unacceptable with errors or based on grounds that did not pass muster.

For Nick, there will be no accepting anything as fate, a plea or a given until he has extinguished any and all avenues to have the search warrant deemed invalid. Given that they knew he was a lawyer and had some weight and wasn't a regular Joe, they likely ensured the Search Warrant was airtight and on point as other more informed and better educated KFers have pointed out. If it is made invalid, they've got nothing on him and this entire episode is pretty much over for him.

I do look forward to Nick's disappointment in this, that in itself, will make a fine moment as that candle of hope is extinguished. Bookmark that day because the clouds and doom of reality will fill his skies.
