Its easier than you might think and happens fairly often in canada. The whole 'no body no crime' idea hasn't been a thing for at least the last couple decades. They don't need to prove she's dead they only need to prove she hasn't been seen, heard from or provably done anything a normal, living person would be expected to do (which evidence so far is is heavily pointing in that direction) and the prosecutors and court can prosecute under the assumption that she's dead and treat the case as such. When she left the last time everybody knew it, it was for only two weeks, she didn't leave everything she had, including her kids at home, she was in constant contact with family, JF mentioned her leaving and didn't get sketchy and suspicious about it and she didn't disappear off the face of the earth for several months. tbh I think it's just wishful thinking on devin's part cause he does not want someone he's tangentially related to to be guilty of killing his wife.
