They would never go for first degree murder unless they have serious proof which none of us are currently aware of. The burden of proof for that sort of charge is just too high.

There are some people here not even sure that she's been murdered. So convincing a jury he actually killed her as opposed to giving him a plea deal or going for a lesser charge where they only have to prove wilful endangerment, would be a dumb choice.

If and when they charge him, we should get a better idea of what kind of evidence they have. If they charge him with First Degree, I would guess they have pretty incriminating evidence. If they charge him with criminal negligence or some lesser charge, it's likely just circumstantial bullshit. It is going to be hard to charge him with anything without actual proof that she is no longer alive.

Concerning the Daily Beast article, why is it not surprising the journoscum missed the important detail about common law marriage? That stated, as someone who likes some of JF's commentary, having his quotes transcribed on print demonstrate how bizarre some of his commentary is. In the interest of fairness the author should have emphasized to those unfamiliar with him that he is French Canadian and very often utters words or phrases that are peculiar to a native speaker or someone with a truly excellent command of English.

Its easier than you might think and happens fairly often in canada. The whole 'no body no crime' idea hasn't been a thing for at least the last couple decades. They don't need to prove she's dead they only need to prove she hasn't been seen, heard from or provably done anything a normal, living person would be expected to do (which evidence so far is is heavily pointing in that direction) and the prosecutors and court can prosecute under the assumption that she's dead and treat the case as such. If he thinks he's going to avoid a conviction because nobody has found a body he's in for a big surprise

Except she hasn't done anything like this before. When she left the last time everybody knew it, it was for only two weeks, she didn't leave everything she had, including her kids at home, she was in constant contact with family, JF mentioned her leaving and didn't get sketchy and suspicious about it and she didn't disappear off the face of the earth for several months. That isn't what happened here at all. There is a pretty big difference between the two situations

The RCMP certainly thinks he did and wouldn't have worded their official response to the media inquiries the way they did unless they were investigating with the intent to prosecute

That said lets all take a moment to realize how ironic it is that he uttered this statement some time ago, I found it on page 1 of the thread:

That stands a pretty good chance of coming back to haunt him at this point

Sorry, I don't have time to look it up right now, but he definitely claimed in the interview that it is common in French to refer to the living in the past tense, which French speakers in Null's chat immediately called out as false. He was saying this in English during the interview. so we don't need any translation, just a French speaker who knows whether or not this is a thing. He has referred to her in past tense probably a dozen times in the past week in various interviews and comments. While his accent is thick, his English is decent, and I doubt this was some "lost in translation" moment.

When I talk about my ex in french, I use the past tense, because it sounds weird to talk about someone who is not in my life anymore the present tense. 'didn't know it sounded weird in english.

That particular fact pattern would not be murder, but criminally negligent manslaughter (or whatever the equivalent is called in Prince Edward Island) arising from a custodial duty of care that a (common-law) spouse owes the other spouse, and as far as I can tell that would be a stretch if he can demonstrate she choose to do this. There is also potentially a causation problem if it turns out she was raped and killed while hitchhiking or slumming it in some homeless camp a month ago.
I have not researched the ins and outs of criminally negligent manslaughter in Prince Edward Island or Canadian law at large and I doubt you have either.
I would also like to pin down precisely what her impaired cognitive abilities actually are. I am pretty sure there is something wrong with her (based on how she speaks, her bizarre outbursts, the way she decided to become his broodmare) but I am not entirely sure what.
