I don’t think Phil is smart enough to pull off a legitimate ruse

The only ruse, as such, is that Phil’s being evicted, rather than moving out peacefully by his own free will.

He would of likely dropped hints that this is a ruse, and as others have just mentioned, he's not really smart or patient enough to pull off...
