Wouldn't that drastically devalue the stock price and basically fuck their own investors which, if I understand it correctly, would open them up...

I doubt any judge anywhere would look at the timing of the offer, and of the split, and not want to rape to death whoever ordered the split.

Pretty sure at that point Musk could just readjust his offer to account for the new stock price.
