Its up to the Judge if an objection is valid or not. As with these overrules this Judge doesn't think most of the state objections are valid.

Was Floyd ever pronounced dead at the scene? That could factor into what he said, especially if he wasn't confirmed deceased when the EMTs arrived.

Only a doctor can pronounce death. So the EMTs would’ve had to call the doctor at the hospital in order to have him pronounced dead at the scene but they were attempting to resuscitate him.

Its more that he can't just generally assert it, has to assert it when actually on the stand. I think. I don't remember. Maybe he'll be back
