He might have to respond to the current motion in some way, but the Notice of Appeal is already filed and became actually effective the instant the ink hit the paper on the final judgment. I'm sure the situation has arisen before, though, so I assume there's some precedent on it.

I honestly don't see what benefit Lemonhead is going to get out of trying to force the judge to do something he clearly doesn't want to do, and that even if he does, would just further serve to undermine the ruling he already has because there's absolutely no way to justify it. That would seem to be the last thing this wheezing, gasping sack of mosquito refuse should want.

I also don't see the rule allowing the defense lawyer to rub the judge's nose in one part of the judgment he doesn't like and say "and you're only allowed to talk about that one thing" either. Lemonhead just made that shit up.

My current theory is he's looking for some specific thing Chupp writes to take to the COA, instead of appealing the fees generally and trying to make his patently absurd case. He wants to focus on 1 thing, argue against it with bad case cites, then hand-wave and claim that 1 error means the entire fee structure should be tossed in favor of what he originally requested.

Lemon Fuhrer deserved the smackdown morally, but considering how much judgement goes into these determinations, it's 100% likely there's a weak technical justification somewhere in Chupp's reasoning.

Lemontwink wasted hours, and money on things not needed for a proper TCPA defence ( researching Nicky, how to depose him, trying to depose Ty, and Slatosch, and pointless affidavits that contradict each other ); and technically might have forgone the TCPA protections, because he actively sought discovery from the plaintiff, and depositions, therefore possibly indicating that the case does not apply to the TCPA and needs fact finding.

I agree with this 100%, it seems like everything Lemon has done since the dismissal ruling has been things that would undermine his case re: the appeal of TCPA. Whether that's by design or exceptionality, I don't want to speculate. But I feel like everything Lemon has done since the dismissal ruling hurts his case for TCPA appeal. AGain, I mean this in the spirit of the TCPA law, if not the letter. Maybe it has no impact at all due to the nitpicky, anal practices of the legal profession.

He found that they worked too incompetently. Despite billing almost five times what Sam Johnson did, they did a terrible fucking job and screwed their clients. Chupp clearly indicated Johnson had done a better job for less.

I still don't understand how the fuck he was able to tout himself as an expert for all these years, since until a few months ago, he's NEVER won any TCPA cases before.

How the fuck is that an expert? Costs 5x more than a strip mall lawyers, has failed 5-1 compared to them, and now that they finally got a win, can't even convince the judge their fees are justifiable.
