I think someone said that the Judge can actually do that, it's just very rare. I mean, in this case it's pretty obvious that this is a proper case (not a SLAPP) and the worst Casey can do is try to anti-SLAPP it, fail (because everyone and their mothers know this is a proper case) and be left with a mighty pissed-off judge for disrespecting his instructions and wasting everyone's times.

At best, the Judge is just telling Casey there is no way this is going to go away if he files an anit-SLAPP and it would be blatant abuse for trying.

It could be that the Judge does not want to entertain a TCPA until depositions are completed.

Yeah, no. Claims that any statements were made without Malice are immediately defeated by the "I want his head and his balls" tweet. Anything made after that would be seen as made with malicious intent.
Still a better response than what Casey put out.
