They don’t have to accept a settlement. Any settlement offered by Ron would be terrible anyways.

While they technically don't have to accept a settlement offer, they can disadvantage themselves by not doing so. If the amount the court ultimately awards is within a certain percentage of the settlement offer they rejected, they can be liable for the other side's legal costs from the time the offer was rejected (or it may even be when it was made) until the court made an award.

If I was Funimation I’d settle first then I’d throw all the voice actors under the bus.
It would have to be a lot of money. Funimation can be held responsible for the actions of its employees and agents, plus the conspiracy angle means that Funi's deep pockets will be paying everything in the end anyway, if they don't settle out before that happens. If Funimation does settle out, the other three defendants might be more or less judgement-proof. Funimation will have to pay dearly for that privilege.
As I said before I think Soye's lawyer would push for a settlement but I think it's the only one that The Beard wouldn't be interested in. Part of it for the personal grievance he has caused yes, but equally or more so because of courtroom strategy. Ron is the guy behind the most unhinged messages, baseless personal attacks and pretending to be a higher up for Ruination. Ron is the anchor that brings everyone else down to his level - even if the other are all culpable, he's the poster boy for rabid Twitter-court autism. Beard needs to attack him full force to sell his case.

The only way I can see the Beard accepting a settlement with Soye is if he settles for an amount of money roughly equal to Vic legal team's goals for the entire lawsuit - because it would roughly mean winning the case without the costs and gamble of actually going through it. We're talking at least a million dollars here so it's an unlikely outcome - except Soye is so dumb he might do it just to walk away with the bragging rights of having "saved his m'lady from even going to court", although his ego works both for and against this outcome, if he can even pay at all.
I think this will actually be the best course of action for Rial and Soye:

Settle out of court before Funimation does. Ty seems really lenient to people wanting to play ball. Take Kamehacon for example...no paperwork, no mess. Hell, even Vic says he regrets having to go this route, so he might even be cool with just retractions on Twitter. The key is to act fast and be sincere...

There is no Course of Action 2. Settle out of court.
Let's not forget that Soye the supergenius filed a frivolous ethics complaint against Ty Beard.

I think Ron and Monica's best courses of action, that don't involve either of them being taken to court where they'll inevitably lose big, might be "suicide pact" and "murder-suicide".
 
I acknowledge that Ty is a practical man, however... after hearing his reaction to a previous case he was involved with where absolutely moronic ethics complaints were thrown around, I am of the belief that Ty will not be easily persuaded to accept a settlement from Ron. Ultimately he is obliged to do as his client bids and he is professional enough to do that, but I suspect that if a settlement from/including Toye is offered he would not be afraid to let his client know how he feels.
I have been saying that ron will most likely be thrown to the wolves(legally and by his fiance), but I have another reason why even if funi, marchi, and rial settle, ron will still get sued. Someone needs to go to court to truly vindicate vic in the public eyes.. Ron has caused the most ongoing damage and has the least connection to vic.

What I would honestly love to see happen as a reality:

Rial: Settle, but will have to give a full retraction of all defamatory statements, delete said statements, and admit that this was all false information and cannot delete the tweet for 1 years(also pinned for 30 days). Cooperate on giving info to leading to R2+. Also cannot speak of vic publicly(after the retraction) which includes interviews, tweets, post, retweets, likes, favorites, or any other medium of communication

Marchi: Settle and same with the whole retraction, delete, and admit false info(or at least went off bad information). Pin said tweet admitting going off false info for 30 days(also cannot delete for 1 years). Cooperate on giving info to help lead to R2+.

Funi: Settle whether forced by sony or realizing the shit they got into. Will pay roughly 3/4 of the fees vic has asked for in damages. Retract statement indicating investigation of sexual harassment leading to firing. Must also restore vic in the credits on all sold media. Must do a 180 day recall on all sold media without the vic interview or his credit(must make recall public).

Ron: Gutted in court. Will be on the hook for the remaining 25% of vics asking damages. May even end up in contempt of court if he is that exceptional of a moron. Will be used as an example and a case to be pointed at to exonerate vic by the court. More than likely this is the hill he will want to die on

I am also running under the assumption that the lawyer will probably have to drop one or both of them in the future since they will have to probably testify against each other. I also know not all this will happen and some borders on unreasonable.
 
Reading through these threads I think the defendants have a fundamental misunderstanding of exactly what's happening. This has been the case in the entire lead up to suit being filed against them.

They're still trying to find a way to prove that Vic is a "harasser," "predator," and whatever else. Rather than trying to do that what they need to be doing is proving that the specific statements they've made about Vic are true.

The defendants are also publicly crying about these defamation claims but even if the defamation claims were to somehow be dismissed they'd still be on the hook for all the other causes of action like the whole tortious interference thing which sounds like is already in the bag for Ty.

Their biggest problem right now seems to be that they're trying so hard to launch some sort of counter-attack when in reality they need to drop all their gear and run away as fast as possible. Ty has them in a textbook double envelopment right now and as they just keep running full steam ahead it'll turn into an encirclement real quick. This is a very bad place to be and they've played right into their enemy's hand. Stop, assess, analyze, and get the fuck out as fast as possible before the ends of the horseshoe close up behind you. If they push forward, they're dead but they're no less dead if they stand still and get picked off.

At the end of the day: don't file an ethics complaint against opposing counsel, don't attack the plaintiff's mother, and especially don't do them when the opposing counsel is a NOTORIOUSLY aggressive litigator who has made statements about holding back unless you started acting up.
 
@Genkoda What you're proposing are the sweetheart deals the 1st betrayer will get, and I think Marchi is the only one smart enough to knife everyone else in the back to get it.

The only thing I can imagine is not asking for monetary damages. I don't believe Ty would allow a plea deal that wouldn't involve a full retraction and admitting to false allegations.
 
Maybe reading both art of war and Vom Krieg would help, getting to know your enemy better will never hurt and the chances that mr Beard read all 3 of those books is pretty high(well not so high on one of the Art of Wars, but still, cant do anything wrong with reading Machiavelli.

After all the evidence still hasn't been sent to TY that he requested in discovery much less expanding the web with the other possible defendants(or the evidence he holds himself prior to the request for discovery). A possible solution, depending on how it unfolds, is to shift blame for some of the conspiratorial actions to one of those parties and showing proof of threats or coercion. There is still far to go in this series so I look forward to the next part.

We don't know what has been delivered in terms of discovery documents. But the current litigants can't wait on any other defendants. Those will be in Federal Court of or when they happen. They have no connection to this, and these litigants have their own court schedules.

Not necessarily, if they could prove that Texas should have jurisdiction over the other parites then they can be added to the current litigation without having to go to federal court. And given how another case Nick covers in Waid v Meyer just got pulled into Texas there is a healthy precedent if they can pull it off. Adding more actors means more payout in this one lawsuit after all.

Anybody who brags that hard is not only a douchebag, but likely doesn't really have that much money.
