I want Nick to do a show about this, not just because it's something that bubbled to the surface among the Vic stuff, but also because I'm genuinely curious how a criminal defense attorney would approach a case where the only defense is a bullshit theory that would be hard for any jury to believe.

I get that a public defender would wanna plead this out, and maybe PDs aren't the best judge of innocence, but I don't think any amount of money you throw a private attorney is gonna make a shit defense smell like roses.

Nah, a mildly competent Private Attorney could plead this down to something without the lasting consequences. It’s only four instances of CP found on the drive, and looking through his criminal history it is pretty clear and absolutely provable that he is not simply a moron, but a fucking moron. A good lawyer could plead him down to Gross Fucking Stupidity in the First Degree. And cut some sort of livable deal. A PD wouldn’t have the time or incentive to make the effort.
