There's still room for argument over whether its act worthy or not, but its not such a poor argument that it'd be instantly laughed out of court. It'd need to be solid confirmation though, not just "I saw a name in a telegram chat where anyone could name themselves anything". They'd have to seize devices belonging to Waltz and Co that are actively logged into those chats and showing they sent instruction or had administrator type access for their accounts.
