That is, 2 out of 4 criteria for fair use being met, giving more than enough room for Ethan to lose the lawsuit.

Even recently, he said he was suing a guy called ShaunDaBlack (where the fuck to they find these people??) to, in Ethan's words, "do a little trolling". The Merits of the suit are good based on the explicitly stated goals of each of the defendants to create a market replacement for Ethan's content which is an important part of any fair use analysis. The fair use analysis is not a checklist, its an analysis that takes the whole into account. The fact that they are openly trying to create a substitute in the market and being financially rewarded for doing so is what is going to bite them here, the question of did they react enough etc is almost immaterial.

Like someone like Kaceytron is incredibly, incredibly fucked. Denims probably has more of a shot but frankly, that doesn't matter. Saying XQC barely talked too is not a defense in court actually, the bigger issue for all the defendants is the market substitute part of the analysis.

I was aware of this when I made my post, and the thing here is, that's is worst for Ethan. The copyright statute almost by design gives immense lenience to a judge to throw out the suit. Firstly because they can weight in these factors in the way they'd like on a "case by case" basis which ignores precedent, meaning, they could look at one of these criteria's, such as "the nature of the copyrighted work", and say, "it is so egregious that the plaintiff made a social critique video and called for people to reply to him only to file a lawsuit, that the nature of the work does not allow for copyright protection regardless of the other factors".

I believe that this is by design; the users of copyright law were typically exclusively petty corporations, so the lenience given to the judge is there to deter any suit that is short of for-profit piracy. As I've heard Pisco pointing out, big corporations aren't filing copyright lawsuits as often as people think they are.

My take is that he has one criteria that is solidly in his favor, which is the video being played in full.
The criteria of his work being replaced by the infringer as an effect on the market is very debatable. I believe that these VODS he's suing for are nearly double the duration of the Content nuke, judges have argued that's enough to make a difference; Ethan's claim that they're just leaving the chair there for hours is false. Here's a question: how many people go "Hey, I want to watch this Content Nuke thing, where can I watch it?.... Oh, I know, Denims reviewed in full, I can just watch her VOD and skip the parts were she speaks!".

I'm seriously not even sure if the statements that they're "stealing the video" is even part of the fair use review. It shouldn't be too different than a movie reviewer saying people shouldn't give money to a movie. It's a statement on reddit, it's a claim of what they want to do perhaps, not whether or not their work utilized fair use. You can theoretically steal someone's views by making fair use content.
